A 66-year-old Dunkirk man is facing a two-year state prison sentence and 10 years of post-release supervision after pleading guilty to a third-degree rape charge.

The plea by James Miller was announced Tuesday by the Chautauqua County District Attorney’s Office.

Miller was taken into custody in July 2021 for an alleged incident that occurred in May 2021. Dunkirk police have not released information regarding the incident.

The Dunkirk man is set to appear in front of County Court Judge David Foley at a later date for sentencing.

The DA’s office thanked Dunkirk police for its “work on the investigation and their assistance in prosecuting the defendant that led to the conviction.”
