Arrest Made In July Shooting Death

An arrest has been made in connection with a July shooting death in the village of Sinclairville.

Chautauqua County sheriff’s deputies report they made the arrest before noon Thursday in the death of 19-year-old Joseph Misciagno on July 5. After the case was presented to a Chautauqua County grand jury by District Attorney Jason Schmidt, Judge Stephen W. Cass signed an arrest warrant for the charge of first-degree manslaughter.

The defendant was arraigned on the indictment and remanded without bail. Pursuant to New York state law, the defendant’s name was not released. This arrest stems from a lengthy investigation by the Chautauqua County Sheriff’s Office and Chautauqua County District Attorney’s Office.

At the time of the incident in the summer, law enforcement said the Cassadaga man had died after he was shot in the lower back during a “scuffle” during the evening.

Chautauqua County Sheriff James Quattrone in July said Misciagno was among six people in the area of Reed and Park streets in Sinclairville around 7:30 p.m. when the incident occurred. It wasn’t clear what led to the altercation, but at some point the victim was struck in the back with a single gunshot.

After being shot, Quattrone said Misciagno got into a truck and drove for about a quarter-mile before the vehicle left the road and struck some trees. The vehicle did not sustain much damage.

Quattrone said it was not apparent at first that the victim had been shot, leading to some initial confusion as to what caused the man’s injuries. “At this time we do believe that the gunshot wound may have caused his death but we’ll wait for the autopsy results,” the sheriff said.

The 19-year-old was with another person at the time of the shooting. The scuffle included four other individuals, described by Quattrone as “persons of interest.”
