Man charged after striking shoveler with weapon

A 55-year-old man is facing a number of charges after an incident with a weapon on New Year’s Eve.

Dunkirk Police report Jerry J. Small was charged with third- and fourth-degree criminal possession of a weapon, third-degree menacing, trespass and second-degree harassment.

Officers received a complaint that an unknown man came on a complainant’s property and attempted to hit them with a homemade weapon after 4:30 p.m. Patrols reviewed the footage they provided and identified the suspect as Small.

The video shows Small come on their property as they were shoveling and the complainant asks Small to leave. He refused.

Small then swings a homemade nunchucks, striking the complainant and walking away. He was located a short time later and taken into custody. Nunchuck sticks are illegal in New York.

Small was held for arraignment and later released.

CHAUTAUQUA COUNTY SHERIFF’S DEPARTMENT

– CHAUTAUQUA — Jeremy D. Chambers, 45, of Bemus Point, was charged Thursday with driving while intoxicated, speeding, and failure to keep right. According to officials, at about 4:46 a.m., deputies were dispatched to a vehicle complaint on Bowman Avenue. Upon arrival deputies located the vehicle, which was stuck in a snowbank, and identified Chambers as the driver. Through am investigation it was found that Chambers allegedly was driving while intoxicated. He was placed in custody and transported to the Chautauqua county Sheriff’s Office for processing. He was later released and will be in Chautauqua Town Court later.

— HANOVER — Matthew V. Conti, 33, of Hanover was charged Thursday with second-degree criminal mischief, and first-degree unauthorized use of a motor vehicle. According to officials, at about 6:35 p.m., deputies and New York State Police Troopers were dispatched to an address in the town of Hanover for a past-tense altercation. After an investigation, it was determined that Conti allegedly did intentionally operate a motor vehicle that wasn’t his, and purposefully crashed the vehicle into another at the incident location. Conti was placed into custody, and taken to the Chautauqua County Jail. He will be in Hanover Town Court later.

ELLICOTT TOWN POLICE

— Alberto Narvaez Aponte Jr., 41 , of Jamestown was charged Dec. 27 with petit larceny. According to police, at about 9 p.m., officers responded to a street check where it is alleged that the Jamestown Police Department had Aponte stopped on a separate incident. Aponte did have an active warrant from the Ellicott Police Department for petit larceny that occurred Nov. 19. Aponte was placed into custody, and taken to Chautauqua County Jail. He will be in Ellicott Town Court later.

— Kevin L. Newby, 54 , of Jamestown was charged Dec. 18 with unlawful possession of a weapon. According to police, officers responded to Falconer Central School for a report of a suspicious person who allegedly came on the school property in the overnight hours gathering items from a school trash container. School video cameras allegedly recorded Newby to possess an exposed weapon in his waistband. Officers located Newby, and was placed into custody, released with an appearance ticket. Newby will be in town court later.

— Tina L. Larsen, 45 , of Jamestown was charged Dec. 18 with two counts of first-degree criminal contempt, two counts of endangering the welfare of a child, second-degree harassment, and fourth-degree criminal mischief. According to police, officers responded to a domestic dispute in progress, where it is alleged Larsen got into a physical altercation with two juveniles at the residence. Larsen allegedly left marks on the juveniles and damaged property. Police said Larsen violated orders of protection when the alleged incident took place. Larsen was placed into custody, and taken to county jail. She will be in town court later.

— Ralph R. Patterson III, 45 , of Jamestown was charged Dec. 26 with resisting arrest. According to police, officers responded to a 911 call where it is alleged Patterson and another male were unwanted at a residence. Due to having outstanding EPD arrest warrants, Patterson fled from the scene on foot and was located by officers a short time later. Patterson was placed into custody, and issued an appearance ticket. He will be in town court later.

— Eduardo L. Rivera, 26 , of Jamestown was charged Dec. 26 with petit larceny. According to police, officers responded to a shoplifting complaint at CVS Pharmacy, located in Falconer, where it is alleged he entered the business and stole merchandise from the store. Rivera was located nearby, placed into custody, and issued an appearance ticket. He will be in town court later.
