City Man Charged With Trespassing Twice Tuesday

A Jamestown man was charged with trespassing in the same apartment house twice in the span of about four hours early Tuesday morning.

Jamestown police officers responded to a trespassing complaint around midnight Tuesday and found Marcus A. McAfee, 35, inside the building. According to a police report McAfee had been removed from the property around a year ago and was not welcome there. McAfee was informed he was under arrest, at which point he allegedly pulled away from officers and attempted to run away. According to a police report officers struggled with McAfee while taking him to the ground. He was eventually charged with third-degree criminal trespass and resisting arrest before being released because the charge wasn’t bail eligible.

Police responded to the same address at 4 a.m. Tuesday for another trespassing complaint. Upon arrival officers made contact with McAfee inside an apartment in the building. Officers knew McAfee was not allowed on the property as he had been arrested there previously in the shift, according to a police report. This time Mcaffee had entered a person’s apartment while the person was asleep. Marcus was charged and taken to the city jail until he could be arraigned.

In April, McAfee was charged with second-degree assault (on a police officer), second-degree obstructing governmental administration, resisting arrest, third-degree aggravated unlicensed operation and traffic citations after a traffic stop near Lakeview Avenue and Crossman Street. During that incident McAfee allegedly refused to get out of the car when officers told him to and fought with officers, including biting an officer. In March, McAfee was charged with first-degree criminal contempt at 1:14 a.m. Thursday after officers responded to a north side home for a reported domestic dispute. McAfee allegedly shoved a person who had an active order of protection against him.
