CHAUTAUQUA COUNTY COURT

– Dan Crisoptimo Baez, 33, of Rochester, was sentenced Monday, to a determinate state prison sentence of 5 years with 5 years of post-release supervision after being convicted of second-degree attempted criminal possession of a weapon, a class D violent felony. In March, the New York State Police conducted a traffic stop of Crisoptimo Baez’s vehicle in the town of Portland. Upon search of the vehicle, troopers located a loaded 9 mm pistol and arrested Crisoptimo Baez, charging him with second-degree criminal possession of a weapon, a class C violent felony. In July, Crisoptimo Baez pled guilty to the lesser charge. He was sentenced as a predicate felon for having more than one felony conviction within 10 years. He was also on New York State parole at the time of the incident. District Attorney Jason Schmidt would like to thank the New York State Police for their work on this case. This case was prosecuted by Assistant District Attorney Erik Bentley.
