CATTARAUGUS COUNTY

SHERIFF’S OFFICE

¯ CATTARAUGUS — Kyle A. Fisher, 53, of Gowanda, was charged with driving while intoxicated and aggravated DWI. Fisher was taken into custody around 9:13 p.m. Oct. 2 following an investigation. He is scheduled to appear in New Albion Town Court later.

¯ COLDSPRING — Tonya Kirkpatrick, 40, of Coldspring, was charged with second-degree harassment. An investigation found that Kirkpatrick was allegedly involved in a neighbor dispute at 3:23 p.m. Oct. 5 that included yelling obscenities and other words. She is scheduled to appear in Coldspring Town Court later.

¯ SALAMANCA — Michael Augusta, 36, of Salamanca, was charged with fifth-degree criminal possession of a controlled substance, second-degree unlawfully manufacturing of methamphetamine and endangering the welfare of a child. Augusta was taken into custody Thursday at 12:54 a.m. on a warrant issued by Cattaraugus County Court. He was transported to Cattaraugus County Jail for further court proceedings. The Sheriff’s Office was assisted by Salamanca police and the Western New York Regional Drug Task Force.

STATE POLICE

GERRY — State Police in Jamestown charged Miguel Virella, 22, of Dunkirk, with driving while ability impaired by drugs on Friday.

Virella was pulled over on Route 60 for a traffic violation and after failing several sobriety tests, Virella was placed under arrest.

Virella was transported to Fredonia where he was evaluated by a New York State Police Drug Recognition Expert and determined to be under the influence of marijuana. A blood sample was secured from Virella at Brooks Memorial Hospital in Dunkirk. Virella was then processed, issued tickets and released. Virella is scheduled to appear in the town of Gerry Court on a later date.
