CHAUTAUQUA COUNTY SHERIFF’S OFFICE

¯ ELLERY — Patrick L. Lucariello, 82, of Ellery was charged with trespassing and petit larceny. Deputies responded Monday at 3:30 p.m. to an address on Route 430 in the town of Ellery for a possible trespassing complaint. It was found that Lucariello allegedly remained unlawfully on the premise and took property that wasn’t his. He is scheduled to appear in Ellery Town Court later.

¯ KIANTONE — David F. Burkhart III, 27, of Jamestown was charged with second-degree menacing and fourth-degree criminal possession of a weapon. Deputies responded Thursday at about 7 p.m. to a residence on Route 60 in the town of Kiantone for a report of a person with a weapon. An investigation found that Burkhart allegedly used a hammer to threaten another person at the residence. He was taken to Chautauqua County Jail for centralized arraignment.

ELLICOTT POLICE DEPARTMENT

¯ Austin T. Thayer, 23, no address listed, was charged with second-degree criminal contempt. Officers stopped a vehicle Thursday at 11:30 p.m. and found that Thayer was allegedly in violation of a court order to stay away from another person. He is scheduled to appear in Ellicott Town Court later.

JAMESTOWN POLICE DEPARTMENT

¯ Benjamin J. Ernewein, 37, of Jamestown was charged with second-degree unlawful imprisonment, fourth-degree criminal mischief, third-degree assault, open container, driving while intoxicated and DWI per se. Officers were called Thursday at 11:30 p.m. to help locate a gray Toyota involved in a domestic dispute in the town of Ellicott. The vehicle was found on Maple Street near Arnold Street. A female with blood on her face fled from the vehicle. Ernewein was found to be intoxicated and allegedly assaulted the female in the vehicle. He was taken into custody and transported to Jamestown City Jail.

¯ Frank J. Bindics, 44, of Jamestown was charged with aggravated family offense, first-degree criminal contempt and second-degree unlawful imprisonment. Officers responded Thursday at 7:30 p.m. to Genesee Street for a reported domestic dispute. An investigation found that Bindics had struck the female in the head several times and restrained her. He was transported to city jail and held for arraignment.

¯ Dennis A. Wallace, 42, no address given, was charged Thursday at 11:05 a.m. with third-degree criminal trespass, fifth-degree criminal possession of stolen property. According to police, officers responded to 283 Fairmount Ave. for a reported burglary. Upon further investagtion, it was revealed that Wallace was located by a maintenance worker in a condemned apartment building and then allegedly fled the scene. Wallace was found at Dollar General, 601 W. Third St. and taken into custody. Upon taking Wallace into custody, officers found Wallace to be in possession of an alleged stolen license plate from a local car dealership. Wallace was taken to city jail and will be in city court later.

¯ Brook A. Teagarden, 19, of Jamestown, was charged Thursday at 4:45 p.m. with petit larceny. According to police Teagarden was allegedly attempting to steal merchandise from Wal-Mart in Lakewood. Teagarden will be in Busti Town Court later.

¯ Paul M. Otto, 29, of Jamestown, was charged Thursday at 3:04 p.m. with petit larceny, and third-degree burglary. Otto was allegedly attempting to steal merchandise from Wal-Mart in Lakewood. Otto will be in Busti Town Court later.
