Man, 26, Sentenced On Child Porn Charge

A Mexican citizen living in Dunkirk convicted for possessing child pornography has been sentenced to 10 years in prison and 30 years supervised release.

David Flores-Torres, 26, was sentenced Wednesday in front of U.S. District Judge Lawrence J. Vilardo in Buffalo. The Dunkirk resident was recently convicted on a charge of possession of child pornography involving a prepubescent minor

A search warrant was executed June 5, 2018, at Flores-Torres’ residence in Dunkirk. Officers seized the his Samsung Galaxy S3 cellphone, which reportedly contained 79 images and 14 videos of child pornography.

“Some of the images depicted prepubescent minors or minors less than 12 years-old, as well as depictions of violence,” U.S. Attorney James P. Kennedy Jr. said. “Torres also received and distributed images constituting child pornography from and to others with whom he communicated using a cellular telephone and the internet.”

Special assistant U.S. Attorney Jeremy V. Murray handled the case.

Flores-Torres told investigators that between 2017 and 2018, he engaged sexual contact with two minor victims under the age of 18. The government advocated for a sentence of between 14 and 17.5 years in prison, which was the sentencing range recommended under the U.S. sentencing guidelines.

Wednesday’s sentencing is the result of an investigation by Homeland Security Investigations, under the direction of Special Agent-in-Charge Kevin Kelly.
