Gagliano Pleads Guilty To Vehicular Manslaughter
MAYVILLE — A Lakewood man who struck and killed a young man in Ellery last year pleaded guilty in Chautauqua County Court on Thursday.
Jude M. Gagliano, 29, appeared before the Hon. David Foley in court in Mayville where he pleaded guilty to the only count in the indictment of second-degree vehicular manslaughter. Gagliano is set for sentencing on Nov. 6, according to the Chautauqua County District Attorney’s Office.
The guilty plea stems from an incident during the evening of Sept. 2, 2016, in which Gagliano struck the vehicle of 22-year-old Charles Clutter at the intersection of Sinclair Drive and Route 380 in the town of Ellery. Clutter, of Stockton, died as a result of the crash.
Police said Gagliano was allegedly driving while intoxicated in his pickup truck and failed to stop at a stop sign. After investigating the crash, the Chautauqua County Sheriff’s Office obtained a search warrant from Ellery Town Court and arrested Gagliano. After being arraigned in Ellery Town Court, he was remanded to the Chautauqua County Jail where he later posted bail.
