Jamestown Man Sentenced To Three Years In Prison
MAYVILLE – A Jamestown man will spend the next few years in state prison on drug-related charges.
That and several other pleas and sentences were announced by District Attorney David W. Foley in Chautauqua County Court this week.
Marcus A. Caceres, 27, of Jamestown was sentenced to a determinate time of three years in state prison with three years of post-release supervision for third-degree criminal possession of a controlled substance, concurrent with three years in state prison with three years of post-release supervision for second-degree criminal possession of marijuana.
In May 2013, city officers joined members of the New York State Police Community Narcotics Enforcement Team executing a search warrant at 146 Barrows St. in Jamestown after an investigation into the illegal growing of marijuana by Caceres. Inside the location, investigators discovered 59 individually potted marijuana plants as well as multiple items of equipment used in the growing process. A .50 caliber muzzle loader rifle was also located in the residence.
During a search at 96 Water St. in September 2012, officers found 7.6 ounces of powder cocaine along with a quantity of cash. The street value of the cocaine was more than $30,000. Caceres was charged with second-degree criminal possession of a controlled substance in that incident.

SENTENCES
Najee T. Finley, 20, of Dunkirk was sentenced to three years determinate in state prison and three years of post-release supervision for second-degree attempted criminal possession of a weapon, concurrent with one year in jail for fifth-degree criminal sale of a controlled substance.
In November 2013, Finley was charged with second-degree criminal possession of a loaded firearm, second-degree menacing, second-degree obstruction of justice, endangering the welfare of a child and second-degree harassment after an incident on the 500 block of Park Avenue around 1 a.m. after officers were called to investigate a domestic dispute. Officers said Finley had threatened the life of a female with a firearm. He was located by patrols in the area, and he physically obstructed officers while attempting to run away, police said. He allegedly struggled with officers as they attempted to conduct a safety search for a weapon and was found to be in possession of a loaded firearm.
Joshua A. Powell, 28, of Mayville was sentenced to a determinate time of three-and-a-half years in state prison with three years of post-release supervision for second-degree burglary.
In December 2013, Chautauqua County Sheriff’s deputies responded to a residence in Mayville for a possible burglary in progress. Before police arrived, Powell allegedly fled the scene. Deputies were able to locate him behind a business in Mayville, and Powell did not have permission to be in the dwelling and attempted to remove multiple items from the residence, police said.
Matthew Buchanan-Ruiz, 23, and Ricardo M. Ruiz, 20, both of Dunkirk, were sentenced to two to six years in prison for third-degree burglary. In May, they were charged with third-degree burglary and third-degree grand larceny with burglary at Old Sarge’s Drop Zone located on the northeast corner of Central Avenue and Fourth Street in the city of Dunkirk, across the street from Dunkirk City Hall and the Dunkirk Police Department Headquarters.
Luis A. Acevedo, 47, of Jamestown was sentenced to two years determinate in state prison with one year of post-release supervision for fifth-degree criminal sale of a controlled substance. Acevedo was charged in April after police conducted seven drug raids in a self-described “joint narcotics enforcement sweep” of heroin and cocaine trafficking in Jamestown.
Noel Irizarry, 26, of the Bronx was sentenced to two to four years in state prison for third-degree robbery.
Justin C. Matteson, 25, of Dunkirk was sentenced to one and one-third to four years in state prison for third-degree criminal possession of a weapon. In May, Matteson was apprehended after allegedly trying to shoot another individual during an argument. The individual was not struck by the bullet, and no one was injured.
Klarisa J. Foster, 24, of Silver Creek was sentenced to one to three years in state prison for third-degree burglary.
In September 2013, deputies responded to the South Dayton-Silver Creek Road for a reported wanted subject. Upon arrival, deputies were advised that Foster had fled into a wooded area. Chautauqua County K-9 Unit was brought to the scene in an attempt to locate her. She had fled into a heavily wooded and overgrown area, police said. K-9 Drago was able to work through the densely wooded area and located Foster who hid in a ditch under brush and overgrowth.
Randy Haskins, 22, of Sinclairville was sentenced to one year in jail for first-degree criminal contempt.
In November 2013, officers conducted a traffic stop on Haskins’ vehicle at the intersection of Bowen and Price streets. During the stop, Haskins allegedly provided a false name to police. After officers determined Haskins’ identity, they found a valid order of protection for Haskins to stay away from another occupant in the vehicle, police said. Haskins was charged with aggravated family offense for a previous domestic violence conviction.
Santiago Meneses, 52, of Lakewood was sentenced to one year in jail for first-degree criminal contempt. In May, police were called to 154 Chautauqua Ave. for a report of a domestic incident. Meneses was located at the residence where a woman lived. The woman had an order of protection against him. Investigation revealed that Meneses choked, pushed and punched the female, police said. He also displayed a hammer during the incident.
Patrick S. Seekings, 22, of Jamestown was sentenced to one year in jail for third-degree burglary. In March, Seekings entered a home unlawfully and stole a Samsung computer tablet, police said. Seekings was also charged in August 2013 with fifth-degree criminal possession of stolen property and third-degree criminal trespassing when officers responded to a complaint of subjects taking copper from a dumpster at Titan X.
Shaun C. Lawson, 26, of Cheektowaga was sentenced to one year in jail for felony driving while intoxicated. In July 2012 and 2011 he was charged with DWI and DWI per se.
Jacob Soggs, 32, of Silver Creek was sentenced to seven months in jail for sex offender failure to report change of address.
Devin J. Smith, 22, of Dunkirk was sentenced to six months in jail and five years of probation for third-degree criminal possession of a weapon.
Samuel J. Barreto, 24, of Dunkirk was sentenced to six months in jail and five years of probation for menacing a police officer.
Michael Brown, 43, of Stockton was sentenced to six months in jail, five years of probation and a $1,500 fine for felony driving while intoxicated.
Kenneth Drake, 37, of Ashville was sentenced to five years of probation and a $1,000 fine for first-degree aggravated unlicensed operation, concurrent with three years of probation, three years of ignition interlock device and a $500 fine for misdemeanor driving while intoxicated.
Amber Duman-Alequin, 37, of Dunkirk, was sentenced to six months in jail and five years of probation for fifth-degree criminal sale of a controlled substance. In December 2012, members of the city of Dunkirk Police Department, the Southern Tier Regional Drug Task Force and New York State Parole executed a search warrant at 634 Main St. in the city of Dunkirk after a three-month investigation into crack cocaine sales.
