Olean Man Receives Four-Year Sentence For Drug Possession, Sale

LITTLE VALLEY-An Olean man convicted of possessing and selling drugs will serve four years in the New York State Department of Corrections, according to Lori Pettit Rieman, Cattaraugus County district attorney.

James M. Hovey, 26, who is presently incarcerated in the Cattaraugus County Jail, was given three concurrent terms of four years for his convictions of third-degree criminal sale of a controlled substance and third-degree attempted criminal possession of a controlled substance.

The charges stem from drug possession and sales incidents that occurred in Olean earlier this year.

Other Cattaraugus County Court activity included:

Jenna L. Shoup, 24, of Hinsdale was sentenced to five years of probation for her conviction of fourth-degree attempted criminal sale of a controlled substance. The incident occurred on Nov.7, 2013, in Olean when Shoup attempted to sell a narcotic preparation.

April L. Kuhn, 35, of Salamanca was sentenced to five years of probation for her conviction of fourth-degree criminal possession of a controlled substance. The incident occurred on Sept. 6 , 2013, when Kuhn acted with another to possess, and potentially sell, a narcotic drug.

Jay T. White, 53, of Gowanda pleaded guilty to driving while intoxicated to satisfy a pending indictment. The incident occurred on Sept. 1, 2013, in Persia when White drove a vehicle with a blood alcohol content of .20 percent. His sentencing is scheduled for Dec. 15.

Daniel E. Dailey, 17, of Olean pleaded guilty to third-degree criminal mischief to satisfy a pending indictment. The incident occurred on Feb. 20 in Olean when Dailey, acting with others, intentionally damaged property worth more than $250. His sentencing is scheduled for Nov. 10.

Randy J. Hinman, 52, of Salamanca pleaded guilty to DWI. The incident occurred on May 4 in Great Valley when Hinman drove a vehicle with a BAC of .16 percent. His sentencing is scheduled for Nov. 3.

John P. Cutler, 31, of Machias pleaded guilty to second-degree criminal sex act and endangering the welfare of a child. The incident occurred between 2010-12 in Machias. Cutler engaged in sexual conduct with a person who was less than 15 years old. His sentencing is scheduled for Nov. 3.

Thomas R. Jones III, 21, of Irving pleaded guilty to third-degree burglary. The incident occurred on April 4 in Perrysburg when Jones entered a building with intent to commit a crime inside.

Chad L. Aurino, 30, of Allegany pleaded not guilty to first-degree offering a false instrument and fifth-degree attempted welfare fraud. The alleged incident occurred on Jan. 23 in Olean when Aurino reportedly filed false information and obtained an unentitled welfare benefit. The case has been adjourned for motions.

Shelton Rowand, 33, of Olean pleaded not guilty to fourth-degree grand larceny and second-degree identity theft. The alleged incident occurred between March 13-18 in Olean when Rowand reportedly used a stolen credit card. The case has been adjourned for motions.

Starr S. Kitchen, 25, of Olean pleaded not guilty to third-degree criminal possession of a controlled substance and third-degree criminal sale of a controlled substance. The alleged incidents occurred on April 2-5 in Olean when Kitchen reportedly possessed and sold a narcotic drug. The case has been adjourned for motions.

Jaci L. Gibbons, 28, of Olean pleaded not guilty to third-degree criminal possession of a controlled substance and third-degree criminal sale of a controlled substance. The alleged incident occurred on Feb. 1 in Olean when Gibbons reportedly possessed and sold a narcotic preparation. The case has been adjourned for motions.

Matthew A. Gimbrone, 30, of East Otto pleaded not guilty to two counts of DWI, consumption of alcohol in a motor vehicle and an equipment violation. The alleged incident occurred on Feb. 1 in Olean when Gimbrone reportedly drove a vehicle with a BAC of .09 percent. The case has been adjourned for motions.

Roscoe Henhawk, 52, of Perrysburg pleaded not guilty to DWI and aggravated unlicensed operator. The alleged incident occurred on March 17 in Perrysburg when Henhawk reportedly drove a vehicle with a BAC of .19 percent. Sentencing is scheduled for Nov. 11.
