JAMESTOWN POLICE DEPARTMENT
Michael Bales, 42, was charged with fourth-degree criminal mischief and third-degree assault. Police on Tuesday at 9:38 p.m. responded to Jefferson Street for a report of a domestic violence incident. After speaking to a female victim, she reported her boyfriend, Bales, allegedly pushed her down a flight of stairs and punched her in the face. The victim said Bales grabbed her cell phone while trying to call police. Bales was located, charge and transported to city jail where he is awaiting arraignment.
LAKEWOOD-BUSTI POLICE DEPARTMENT
Candy W. McBride, 36, of Barrett Avenue, was charged with failure to appear. A warrant was served on McBride, who is currently incarcerated in Chautauqua County Jail on unrelated charges. The warrant was issued after McBride failed to appear in Busti Court to answer charges of fourth-degree criminal mischief and second-degree harassment. McBride is due in court at a later date.
Caren N. Hurlburt, 27, of Chapman Street, Jamestown was charged with fourth-degree criminal mischief. A female victim on Tuesday said Hurlburt scratched her vehicle while it was parked in a parking lot. The incident took place Jan. 16 at 2 p.m. A warrant was issued for Hurlburt and was issued an appearance ticket.
Joseph P. Pratt, 25, was charged with four counts of petit larceny and fourth-degree grand larceny. Police on Tuesday said they held numerous warrants for Pratt for incidents at the Lakewood Wal-Mart during the month of January. Police said Pratt stole several thousands of dollars in merchandise from the store. Pratt was in Chautauqua County jail on other charges. He is due in Busti Court for arraignment.
CATTARAUGUS COUNTY SHERIFF’S OFFICE
EAST OTTO – Roseann K. Loomis, 32, of Meyers Road, was charged with violation of parole. Police on Monday was charged after a warrant was issued from Cattaraugus County Court. She is being held in jail pending an arraignment.

ELLERY – Natalie Rosario, 19, of Erie, Pa., was charged with driving while intoxicated and unlawful possession of marijuana. Troopers were initially sent to a noise complaint on Greenhurst Avenue, when they observed Rosario driving with no headlights on and came to a stop in the middle of the road. Troopers charged her after she allegedly failed several field sobriety tests. A gram of marijuana also was located in the vehicle. Rosario was transported to police barracks and provided a breath sample of .12 percent. She was processed, issued tickets and released to a sober individual.
ELLICOTT – Amber Feldt, 30, of Jamestown was charged with driving while intoxicated after being pulled over on Route 394 for following a plow too closely. Feldt allegedly failed several field sobriety tests and was transported to police barracks where she provided a breath sample of .11 percent. She was processed, issued tickets and released to a sober individual.
Jennifer Hodges, 41, of Randolph was charged with three counts of second-degree criminal possession of a forged instrument. Troopers on Jan. 23 interviewed a subject who said Hodges had been allegedly receiving and holding miner rights checks from a property they jointly owned. Investigation found that Hodges allegedly received the checks, forged the signatures and kept the money. She was processed and released with appearance tickets.

CHAUTAUQUA COUNTY SHERIFF’S OFFICE
WESTFIELD – Nathan Horton, 27, of Pleasant Avenue, Westfield, and Johnathan Hudson, 26, of East Main Street, Westfield, were charged with second-degree criminal mischief and criminal liability for conduct of another. Police said an investigation began between the Sheriff’s Office and Westfield police that led to the charges against Horton and Hudson. Police said on Jan. 7, both suspects allegedly entered a car sales lot and attempted to cut the catalytic converters off two vehicles. Horton and Hudson turned themselves in to Westfield court after warrants for their arrests were issued. Both were committed to Chautauqua County Jail and will appear in court at a later date.
WESTFIELD POLICE DEPARTMENT
Ryan L. Lacey, 19, of Erie, Pa., and an 18-year old Harborcreek, Pa., resident were charged with unlawful possession of marijuana. Police on Jan. 26 at 6:56 p.m. observed a vehicle allegedly traveling at a high rate of speed. Upon investigation, police found two males allegedly in possession of marijuana. Lacey was additionally charged with speeding. Both subjects will appear in court at a later date.
CATTARAUGUS COUNTY SHERIFF’S OFFICE
PERRYSBURG – Jill E. Fried, 36, of Ellicott Avenue, Batavia, was charged with driving while intoxicated, DWI more than .18 percent, failure to maintain lane and open container violation. Police on Jan. 26 at 7:25 p.m. charged Fried after she was found stuck in a snowbank on Prospect Street in the town of Perrysburg. She is due back in court at a later date.
RED HOUSE – Randall S. McMurtry was charged with speed not reasonable and prudent. On Jan. 26 at 5:55 p.m., deputies responded after a tractor-trailer driven by McMurtry traveled off the road on Interstate 86 near exit 19. The tractor trailer traveled down a steep embankment and collided with multiple trees and brush. McMurtry was issued a citation.
OLEAN – Sharon A. Bordonaro, 32, of Maple Hill Road, was charged with possession of a hypodermic instrument. Police on Jan. 26 charged Bordonaro following an incident that occurred Jan. 16 in the town of Hinsdale. She was processed and released and will appear in court at a later date.
OLEAN – Kara U. Greeley, 27, of North Union Street, on Jan. 25 was arrested on a bench warrant issued out of Olean court for failure to appear. She was turned over to sheriff’s deputies and arraigned in Olean court.
NEW ALBION – Corey J. Furl, 29, of Mill Street, East Otto, was charged with second-degree aggravated unlicensed operation, operating with a suspended registration, operating without an ignition interlock, uninsured motor vehicle and obstructed plate. Police on Jan. 20 allegedly observed Furl driving on Lovers Lane with an obstructed license plate. Investigation found had a suspended registration and no insurance. Furl is due back in court at a later date.

CHAUTAUQUA COUNTY SHERIFF’S OFFICE
HANOVER – Starlene G. Schindler, 32, of Rail Road Avenue, Irving, was charged with driving while intoxicated, aggravated DWI, failure to keep right, failure to maintain lane and consumption of alcohol in a motor vehicle. Deputies on Sunday pulled over a vehicle on Route 5 in the town of Hanover. Schindler was found to be intoxicated and was taken into custody. She was arraigned in Hanover Court and was found to have a blood alcohol content of .18 percent. Schindler was remanded to Chautauqua County Jail and will appear in court at a later date.
POMFRET – Dynell D. Scott, 23, of Newark, N.Y., was charged with driving while intoxicated with a blood alcohol content of .08 percent or higher, driving without headlights, insufficient tires, moving from a lane unsafely, unlicensed operation and unlawful possession of marijuana. Deputies on Sunday observed a vehicle on Bennett Road in Pomfret without headlights. Sparks also were seen coming from the passenger side of the vehicle. Deputies noticed after stopping the vehicle that Scott did not have a tire on the front right passenger side of his vehicle and was driving on the rim. Scott will appear in Pomfret Court at a later date.
JAMESTOWN POLICE DEPARTMENT
Steven Pielmeier, of Prospect Street, was charged with seventh-degree criminal possession of a controlled substance and criminal possession of a hypodermic instrument. Police on Saturday were dispatched to Prospect Street to assist Alstar Ambulance and Jamestown Fire Department. Upon arrival, Pielmeier was found unconscious in a vehicle in the parking lot. Police found three hypodermic needles in the vehicle on the dashboard. Further search found several small packages containing a substance believed to be heroin. Pielmeier was transported to city jail without incident and is pending arraignment.
Michael G. Sonn, 50, was charged with second-degree obstructing governmental administration and unlawful possession of marijuana. Police on Friday performed a street check of Sonn, who was believed to have a valid warrant from the city of Jamestown. After making contact, Sonn fled from officers and was caught a short distance later. While taking inventory, police found 11 grams of marijuana on Sonn’s. He was transported to city jail and is awaiting arraignment.
LAKEWOOD-BUSTI POLICE DEPARTMENT
Miguel A. Soto was charged with fourth-degree criminal mischief and trespassing. Soto was charged following a Jan. 25 incident at the Wal-Mart in Lakewood where he purposely damaged four PlayStation controller boxes that belonged to the store. While processing police found that Soto had been banned from all Wal-Mart properties. He was issued an appearance ticket and will be in court at a later date.

CHAUTAUQUA COUNTY SHERIFF’S DEPT.
DUNKIRK – Sonia M. Buchanan-Ruiz, 43, of 44 W. Second St., Dunkirk, was charged with misuse of SNAP/food stamps, third-degree welfare fraud and two counts of first-degree offering a false instrument for filing Thursday. According to a police report, she failed to report someone living in her home was employed, leading to her receiving $7,093.55 to which she was not entitled. She will be in Jamestown City Court later.
CATTARAUGUS COUNTY SHERIFF’S DEPT.
SOUTH VALLEY – Deven J. Dudenhoeffer, 24, of 108 Dennison Road, South Valley was charged with cruelty to animals at 5 p.m. Wednesday at his home. Deputies received a citizen’s complaint. According to a police report, Dudenhoeffer admitted to deputies he shot a dog on Jan. 11. He will be in South Valley Town Court later.
MACHIAS – David A. Smith III, 25, of Junction Road, Machias was charged and taken to the Cattaraugus County Jail Jan. 15 after a warrant was issued by Cattaraugus County Family Court. He will be in court later.
SALAMANCA – Tanya M. Woods, 29, of 53 Eagle St., Salamanca, was charged with violating her probation at 7 p.m. Wednesday after she was taken into custody by Salamanca police officers. She was taken to the Cattaraugus County Jail and will be in court later.
LAKEWOOD-BUSTI POLICE
Jonathan J. Allen, 35, of 139 Lakecrest Ave., Lakewood was charged with failure to stay in lane, driving while intoxicated and aggravated DWI after a one-vehicle accident at 10:35 p.m. Thursday on Shadyside Avenue, Lakewood. According to police, officers were dispatched to a vehicle reported off the road and saw a vehicle pulling away from the side of the road. The vehicle was then pulled over. Allen was given a breath test which showed a blood-alcohol content of .22 percent. Allen will be in Busti Town Court later.

WESTFIELD POLICE DEPARTMENT
Thomas F. Stoughton, 30, of East Main Street, was charged with driving while intoxicated, speeding and covered license plate. Police on Jan. 20 at 11:52 p.m. were on patrol on West Main Street when they observed a westbound vehicle at a high rate of speed. Once pulled over, an investigation found Stoughton to be allegedly intoxicated. Stoughton was charged and will appear in Westfield Court at a later date.
NEW YORK STATE POLICE
PORTLAND – Jennifer Thornton, 29, of Brocton was charged with unlawful possession of marijuana and third-degree aggravated unlicensed operation following a traffic stop Jan. 20 on Route 20 in Portland. Troopers said Thornton had an insecure front license plate when they smelled the odor of marijuana emanating from her vehicle. She would found to be in possession of marijuana and a smoking pipe containing burnt marijuana residue. A DMV check revealed that Thorton’s driver’s license and registration had been suspended for insurance not in effect. Thornton is to appear in Portland Court at a later date.

CATTARAUGUS COUNTY SHERIFF’S OFFICE
RANDOLPH – Brian A. Green, 32, of 103 N. Kings Highway, Randolph, was charged with two counts of petit larceny following an investigation. At 11:56 a.m. on Jan. 3 and 10:38 a.m. on Jan. 9, Green was caught on video taking about $28 and six bags of corn valued at about $42 from Peaches and Cream, 19 Main St., Randolph. He was issued an appearance ticket to appear in Town of Randolph Court at a later date.
ASHFORD – Jesse A. Grzankowski, 23, of 6881 Woodland Drive, Great Valley, was charged at 2:02 a.m. with driving while intoxicated, DWI over .08 percent blood alcohol content and speed in zone following a traffic stop on Route 219 in the town of Ashford. He was processed and released to appear in Town of Ashford Court at a later date.
ELLICOTTVILLE – Christopher R. Fogle, 56, of Westerville, Ohio, was charged at 11:15 p.m. on Friday, Jan. 18, with aggravated driving while intoxicated blood alcohol content over .18, DWI, consumption of alcohol in a motor vehicle, improper right turn, failure to yield and unregistered motor vehicle after being stopped in the town of Ellicottville for an improper right turn, driving on the sidewalk and failure to yield to oncoming traffic. Fogle was observed turning north onto Route 219, and while doing so, he cut the corner, proceeded down the sidewalk near Valerian Way and upon entering the roadway, cut off oncoming traffic, according to police. He was stopped, and a plastic cup containing an alcoholic beverage was observed in the center console of the vehicle. He was arrested and is being held in lieu of $2,500 bail.
GREAT VALLEY – Benjamin L. Boberg, 21; Benjamin W. Bailey, 21; Simon G. Brooks, 21; Joshua P. Dechane, 23; Kristopher W. Mack, 25; Donald B. Moore III, 21, Jonathan C. Pearl, 24; and Skyler P. Martens, 21, were all charged at 11 p.m. on Saturday with second-degree unlawfully dealing with a minor after patrol responded to an underage drinking party on Hungry Hollow Road in the town of Great Valley. Upon arrival, deputies observed the above individuals in the presence of minors Jayson P. Kagelmacher, 20; Anthony J. Fedorowicz, 20; Nathan J. Billings, 19; Bryan S. Kent, 20; a 17-year-old and two 16-year-olds who also had alcohol in their possession. They were also charged with underage possession of alcohol. All are due back in the Town of Great Valley Court.

BROCTON – Christopher A. Moore, 31, of West Howard Avenue, Dunkirk was charged with failure to use a turn signal, driving while intoxicated, and blood alcohol content of .08 percent or greater. On Jan. 13, Moore was stopped for allegedly failing to use a turn signal while making a righthand turn off Central Avenue. He was later released with appearance tickets and is scheduled to appear in court at a later date.
ELLICOTT POLICE DEPARTMENT
Randy A. Haskins, 20, of Livingston Avenue, Jamestown was taken into custody on a warrant for petit larceny. According to police, Haskins allegedly stole property from a business in West Ellicott. He was arraigned in town of Ellicott court. Haskins was then turned over to Jamestown police for an active warrant.
JAMESTOWN POLICE DEPARTMENT
James C. Schnars III, 41, of Jamestown was charged with petit larceny. Police on Monday were dispatched to Tim Hortons for a report of a subject who had allegedly stolen an item from the store without paying and fled the area. Officers located Schnars a short distance from the store and identified him as the subject who had stolen a bag of potato chips. He was transported to city jail where he was held on bail.
Lawrence Rushmore, 57, of East Second Street, Jamestown was charged with second-degree criminal contempt. Police on Sunday responded to South Main Street for a past-tense violation of an order of protection. A female victim reported that Rushmore allegedly attempted to contact her at her residence on Jan. 19. Rushmore had a valid order of protection against him. He was transported to city jail without incident.

Michael C. Demarco, 33, of Beech Street, Jamestown was taken into custody for a bench warrant for failure to appear on a charge of first-degree criminal contempt. Demarco was arraigned in town of Busti Court.

Taylor McFarland, 20, of Dunkirk was charged with unlawful possession of marijuana. State Police on Jan. 11 pulled a vehicle over on Route 60 in Sinclairville. The trooper could allegedly smell marijuana coming from the car. McFarland was found to have a glass pipe containing burnt marijuana. He was issued an appearance ticket for the town of Charlotte Court and was also cited for speeding.
Craig Kopta, 32, of East Johnson Road, Ripley, was charged on Jan. 19 with driving while intoxicated following a traffic stop on Shortman Road for no lit headlights. Police said Kopta had a blood-alcohol content of .12 percent. He was charged with consumption of alcohol in a motor vehicle, uninspected motor vehicle and failing to notify the DMV of an address change. Kopta will answer the charges in town of Ripley Court at a later date.

LAKEWOOD-BUSTI POLICE DEPARTMENT
James J. Spitale was charged for disorderly conduct. Police on Saturday were sent to Park Meadow Lane in the town of Busti for a suspicious person in the roadway. Upon arrival police found Spitale to be in an intoxicated state. Police attempted to check his well-being and find him a ride, but Spitale refused to cooperate and began swearing and laid down in the road and refused to move. As a result he was arrested and arraigned in Town of Busti Court. Bail was set at $5,000-$10,000, and he was remanded to Chautauqua County Jail. Spitale will be back in court at a later date.

DEPARTMENT
Raymond Johnson, of Jamestown, was charged with obstructing governmental administration, criminal obstruction of breathing and blood circulation, second-degree unlawful imprisonment and second-degree menacing. Police on Saturday responded to West Sixth Street for a physical domestic dispute in progress. Upon arrival officers were told by neighbors that a male had dragged a female from outside to inside the residence with his arm around her neck. Officers made contact with the suspect at the front door. Police were able to locate the victim inside the residence with several injuries and in an emotional state. Johnson was placed under arrest and was transported to Jamestown City Jail without incident where he is awaiting arraignment.

RIPLEY – Christopher A. Douglas, 23, of Goodrich Street, Ripley, was charged with a loud exhaust, expired inspection, operating without insurance and second-degree aggravated unlicensed operation. Douglas on Saturday was stopped in Ripley for having a loud exhaust. Further investigation found that he has an expired inspection and no valid proof of insurance. A license check showed Douglas’ license had been suspended four times on four separate dates, none of which had been cleared. Douglas was taken into custody and later released with appearance tickets.
CARROLL – William D. Mattson, 20, of Bone Run Road, Frewsburg, was charged with failure to stop at a stop sign. Mattson was observed not stopping at a stop sign at Old Warren Road in the town of Carroll before crossing the road and striking a utility pole. He was transported to WCA Hospital and will be in court at a later date.
KIANTONE – Jeremy M. Danielson, 33, of Bemus Point, was charged with felony driving while intoxicated, first-degree felony AUO, speeding and unlicensed operator. Deputies on Sunday stopped a vehicle operated by Danielson on Kiantone Road for speeding. After an investigation, Danielson was found to be intoxicated and was arrested. Due to a previous DWI within the last 10 years, his arrest was upgraded to a felony. A record check showed Danielson had a revoked non-driver ID only, the result of a DWI revocation from March 2003. He was taken into custody for processing and a blood test. Danielson is scheduled to appear in Kiantone Town Court at a later date.
MINA – Neville B. Askins, 18, of Erie, Pa., was charged with unlawful possession of marijuana and speeding in a zone. Cassdy C. Earls, 17, of Northeast, Pa., was charged with unlawful possession of marijuana. Deputies on Friday stopped a speeding vehicle on Sunyside Road in Findley Lake. Police detected the smell of marijuana from the vehicle. Following an investigation, Askins revealed he had a blunt in his possession. A younger passenger also was found to be in possession of marijuana and a glass pipe. Both were charged and released with appearance tickets. They will appear in Mina Town Court at a later date.

WESTFIELD POLICE DEPARTMENT
Eran J. Sonney, 23, of Girard, Pa., was charged with a broken windshield and speeding. Police on Wednesday observed a vehicle at a high rate of speed and a broken windshield. Upon further investigation, police found marijuana and a marijuana bong in plain view. Multiple bags of marijuana, ecstasy and Psilocybin mushrooms were in possession by the passenger, Phillip D. Trohoske. He was charged with fourth-degree criminal possession of a controlled substance, and seventh-degree criminal possession of a controlled substance. Trohoske was arraigned in Village of Westfield Court and bail was set at $15,000 cash, $30,000 property. Further charges are pending.
CHAUTAUQUA COUNTY SHERIFF’S OFFICE
LAKEWOOD – Brandon B. Butler, 25, of Cherry Lane, was charged with third-degree criminal possession of a controlled substance and third-degree criminal sale of a controlled substance. Police on Wednesday arrested Butler on an active warrant from City of Jamestown Court based on information supplied by the Southern Tier Regional Drug Task Force. It is alleged that over the course of the last three months, Butler had sold quantities of heroin to agents in Jamestown. He was turned over to the Chautauqua County Sheriff’s Office, arraigned in city court and remanded to Chautauqua County Jail without bail pending further court action. Additional charges are pending.

Justin A. Caruso, 26, of Fairdale Avenue, Lakewood, was charged was issuing a bad check. Caruso was issued an appearance ticket after it was reported that he issued a check with insufficient funds to a business in the town of Ellicott. He will appear in court at a later date.

LAKEWOOD-BUSTI POLICE DEPARTMENT
Carlos R. P. Rodriguez, 31, of Lakewood was charged with second-degree criminal contempt, unlicensed operator and unregistered motor vehicle. Rodriguez was observed operating a motor vehicle without a license, then parked the vehicle and went to a residence of a subject that had a valid order of protection against him. After further investigation, Rodriguez was found to be in the country illegally. U.S. Border Patrol was notified and the subject was remanded to Chautauqua County Jail.
ELLICOTT POLICE DEPARTMENT
Terry L. Kendall, 40, of Allen Street, Jamestown, was charged with second-degree aggravated harassment. Kendall was arrested after police took a report from a Falconer resident in which Kendall had threatened the resident’s life over the phone. A warrant was issued and served. Kendall was arraigned in Ellicott Town Court.
Michael A. Frank, 38, of Fairview Avenue, Jamestown, on Wednesday was stopped by police for a vehicle that was unregistered. Upon further investigation, Frank was found to be operating the motor vehicle on a suspended license and also had a bench warrant out of the Town of Ellicott Court. The warrant stems from a charge of third-degree aggravated unlicensed operation and unregistered motor vehicle. Frank was taken into custody and arraigned for the warrant in the Town of Ellicott Court.
Michael James Pollaro, 27, of Foote Avenue, Jamestown, was charged with criminal possession of stolen property. Police say Pollaro pawned a stolen necklace in late October.
CATTARAUGUS COUNTY SHERIFF’S OFFICE
OLEAN – James W. Mitchell, 26, of Route 16, was charged with forcible touching. On Jan. 12, police say Mitchell without consent forcibly touched the sexual/intimate parts of an 18-year-old female. Mitchell was arrested, arraigned and is being held in lieu of bail.
Donald L. Beckman II, 28, of South Main Street, was charged with second-degree harassment. Deputies report Beckman was involved on Jan. 11 in a domestic incident at his residence. He was arraigned in Dayton Town Court and was released to appear in court at a later date.
CARROLLTON – Nathan A. Domenech, 27, of Bradford, Pa., was charged with moving from a lane unsafely, following too closely, driving while intoxicated, DWI greater than .08 percent and unlicensed operation. Domenech on Jan. 12 was observed moving from a lane unsafely that resulted in a traffic stop on Route 219. He was arraigned in Town of Carrollton Court and released to appear at a later date.

CHAUTAUQUA COUNTY SHERIFF’S OFFICE
MAYVILLE – Jedediah J. Shaw, 30, was charged with third-degree criminal mischief and second-degree obstructing governmental administration. While incarcerated at Chautauqua County Jail, Shaw used a broom handle to smash three sprinkler heads in a fire-suppression system, resulting in $460.19 in damage. Shaw was and will appear in Chautauqua Town Court at a later date.
JAMESTOWN – Dennis L. Penhollow II, 39, of Fairmount Avenue, was arrested on a secret Chautauqua County grand jury indictment warrant. Penhollow had been indicted earlier by a grand jury based on an investigation by the district attorney’s office and Southern Tier Regional Drug Task Force. It is believed Penhollow sold quantities of crack cocaine to agents in the city of Jamestown over the past several months. He was arrested and turned over to the sheriff’s office where he is awaiting arraignment.
KIANTONE – Scott A Nelson, 43, of Columbia Street, Jamestown, was charged with inadequate headlights, driving while intoxicated and aggravated DWI per se. Deputies on Monday stopped Nelson in the town of Kiantone for not having adequate headlights. Investigation found him to be intoxicated and was placed into custody. Nelson was released and is to appear in court at a later date.
CHAUTAUQUA – Rachael A. Blanchard, 30, of Erie Street, was charged with second-degree aggravated harassment. Deputies on Monday charged Blanchard after they said she called and sent unwanted and harassing messages to another person. She was issued appearance tickets and will answer the charge at a later date.

Jordan K. Freeman, 18, was charged with petit larceny Monday at Spencer’s Gifts at the Chautauqua Mall. Police say Freeman stole a bracelet from the store. He was issued an appearance ticket to be in Town of Busti Court at a later date.

An 18-year-old youth was charged for unlawful possession of marijuana. Police walking the beat noticed a suspicious person. Further investigation found the person to be in possession of marijuana in plain view of officers. He was arrested and will appear in Village of Westfield Court at a later date.
Dustin W. Hale, 28, of West Avenue, Portland, was charged with speeding, third-degree aggravated unlicensed operation and criminal possession of a hypodermic instrument. Police on Sunday stopped a vehicle for a traffic violation. Investigation found Hale to have a suspended license and a hypodermic needle under his seat. Hale was arrested and is to appear in court at a later date.
Min S. Yim, 24, of Ithaca was charged with third-degree aggravated unlicensed operation and speeding. Police on Jan. 12 observed a vehicle driving at a high rate of speed. Investigation found Yim to have a suspended license. He will answer the charges in court at a later date.

Michael Pollaro, 27, of Foote Avenue, Jamestown, was charged with criminal possession of stolen property. Police say Pollaro pawned a stolen necklace in late October.
Steven D. Schrecengost, 18, of West Fifth Street, Jamestown, was charged with second-degree aggravated harassment. Police investigated a reported harassment complaint from a town resident. An arrest warrant followed the investigation. Schrecengost was located, arraigned and committed to Chautauqua County Jail and is to appear in court a later date.

Angel L. Avila, 21, and Jose Ramon Melendez-Rosario, 29, both of Jamestown, were arrested Saturday. Police responded to Rite Aid Pharmacy on North Main Street for a reported shoplifting. It was reported two male subjects entered the store and left without paying for two cases of beer. Melendez-Rosario was found to have stolen the beer, while Avila was present during the larceny. Police found that Melendez-Rosario stole two additional cases of beer approximately 45 minutes earlier from the store. He was charged with two counts of petit larceny. Avila was charged with fifth-degree criminal possession of stolen property.
Devon R. Cottom, 30, of Buffalo was charged with second-degree obstructing governmental administration. Police on Friday stopped a vehicle on East Eighth Street at Spring Street. The passenger, Cottom, bailed out due to outstanding warrants for the city of Jamestown. A police K-9 unit was able to track Cottom to a Fulton Street residence where he was found hiding in the basement. Cottom was taken into custody without incident. He was transported to Jamestown City Jail and is currently awaiting arraignment.
Andrew D. Norris, 22, of Washington Street, was charged with petit larceny. Police on Monday were dispatched to Washington Street for complaints of a shoplifter at Dollar General. Upon arrival officers made contact with store personnel who state they saw Norris place merchandise inside his jacket and then attempted to leave the store without paying. Norris was taken into custody and transported to Jamestown City Jail and is awaiting arraignment.
CHAUTAUQUA COUNTY SHERIFF’S OFFICE
JAMESTOWN – Gary J. Bonet-Velez, 27, of Jamestown, wanted by the Sheriff’s Office for burglary in the third-degree, was arrested and is currently in Hillsboro County Jail in Florida. He will be extradited back to New York once the paperwork is completed.
DUNKIRK – Dalia Vazquez, 63, and Norbert Davila, 54, both of Dunkirk were issued appearance tickets for first-degree offering a false instrument and misuse of food stamps. Police say both suspects from June 2011 to September 2011 received income/empl oyment not reported to the county Department of Social Services. Both received $1,424 in benefits they were not entitled to. Vazquez and Davila were issued appearance tickets and are scheduled to appear in Jamestown City Court at a later date.
DUNKIRK – Jacob Stern, 21, was charged with driving while intoxicated, DWI per se with blood alcohol content .08 percent or higher and insufficient tail lamps. Deputies on Jan. 6 stopped a vehicle on Route 60 in the town of Dunkirk for insufficient tail lamps. Stern was found to be intoxicated. He was issued traffic tickets and is to appear back in court at a later date.

Gary A. Kum III, 24, of Barrows Street, was charged with fourth-degree criminal possession of a controlled substance, second-degree criminal possession of a weapon, and third-degree aggravated unlicensed operation. On Jan. 7, police were called for a narcotics investigation. Kum was stopped by officers and found to be in possession of a loaded handgun and a controlled substance. His driving privileges also were suspended. Kum was arrested and arraigned in Town of Ellicott Court and committed to jail without bail.

CARROLTON – Christopher M. Beehler, 37, of Bradford was charged with driving while intoxicated, DWI of .08 percent or greater and unlicensed operation. Beehler was arrested following an investigation in the town of Carrolton. He was taken to the Salamanca Police Department for procession and is due in Carrolton Town Court at a later date.
DELEVAN – Jason A. F. Hogle, 28, of North Main Street, was charged with second-degree aggravated harassment. Hogle was arrested on Jan. 8 and transported to Franklinville Town Court for arraignment. He was released and is to appear back in court at a later date.

STOCKTON – Robert G. Kuhn, 41, of 13 Mill St., Brocton was charged at 7:04 p.m. on Thursday, on Route 380, town of Stockton, with seventh-degree criminal possession of a controlled substance, third-degree aggravated unlicensed operation, unlicensed operator, possession of a controlled substance outside of original container, inadequate head lights and consumption of alcohol in a motor vehicle. Deputies stopped a vehicle and Kuhn was found to have a suspended New York driver’s license. Following an investigation, he was issued appearance tickets and will appear in the Town of Stockton Court.

Kirk P. Krofka, 36, of Frewsburg was charged at 7:15 p.m. on Thursday, with second-degree aggravated harassment. Officers responded to 114 E. Second St., Dugan’s Tavern, for a disorderly male. Krofka was located inside of the bar. It was alleged that he made several racial comments and threatened the life of another person at the bar. Kirk was transported to the city jail, charged and held pending an arraignment.
LAKEWOOD-BUSTI POLICE DEPARTMENT
Todd A. Dellahoy, 40, of 5818 Forest Crossing, Erie, Pa., was charged on Friday with a bench warrant/failure to appear. A bench warrant was served on Dellahoy who is being held in the Chautauqua County Jail on unrelated charges. He failed to appear in the Town of Busti Court on Sept. 5, 2012, in regard to original charges of seventh-degree criminal possession of a controlled substance and a controlled substance violation. A detainer was filed with the jail and he is due in the Town of Busti Court on Jan. 17.

ELLICOTT – James D. Surrena, 42, of 533 Prospect St., Jamestown, was charged with petit larceny. The Ellicott Police Department took a report of a larceny that occurred in an Ellicott business on Dec. 22, 2012. Upon investigation an arrest warrant was filed and the subject was later located. He will appear in the Town of Ellicott Court at a later date.
Erica L. Wisner, 32, of 3 Strong St., Jamestown, was charged with second-degree aggravated harassment. On Dec. 10, 2012, Ellicott Police took a report of a subject receiving annoying phone calls. Investigation led to the arrest of Ms. Wisner. A warrant was served and she was remanded to the Chautauqua County Jail.

WESTFIELD – Connie L. Hogue, 52, of 6900 East Route 20, Lot 2, Westfield, was charged at 11:33 p.m. on Wednesday on East Main Street, Westfield, with inadequate headlights and third-degree aggravated unlicensed operator. Westfield Police stopped a vehicle on East Main Street for an alleged traffic infraction. During the traffic stop, it was found that Ms. Hogue’s driving privileges in New York State were suspended. She was issued traffic tickets and is to appear in Westfield Village Court on a later date.

Juan G. Rivera, 28, of Clinton St., Westfield, was charged with violation of drug court contact. Police on Tuesday assisted with the probation department with a warrant check for Rivera. He was taken into custody on an active bench warrant for the violation of a drug court contact out of the city of Dunkirk. Rivera was turned over to Dunkirk police to answer the warrant.
CHAUTAUQUA COUNTY SHERIFF’S OFFICE
JAMESTOWN – Nathaniel H. Banks, 26, of Jamestown was charged with driving while intoxicated, blood alcohol content of .08 percent or greater, third-degree aggravated unlicensed operation, failure to stop at a stop sign and failure to yield right of way at a stop sign. Deputies on Wednesday at 11:16 p.m. observed a vehicle enter onto Route 60 without stopping and yielding the right of way at a stop sign. After stopping the vehicle, Banks was arrested for DWI. Investigation found his driver’s license was suspended. Banks was processed and released to appear in Jamestown City Court at a later date.

JAMESTOWN – On Jan. 10 at approximately 5:50 a.m., New York State Troopers from the Fredonia barracks took Francis J. Kujawa, of Columbia Avenue, Jamestown, into custody for third-degree aggravated unlicensed operation and unlawful possession of marijuana, following a traffic stop on Route 60 in the town of Pomfret. A Department of Motor Vehicles check revealed Kujawa’s license to be suspended for insurance lapse. A vehicle search revealed Kujawa to be in possession of a glass smoking pipe containing burnt marijuana residue. Kujawa will answer the charges at a later date.
FREWSBURG – On Jan. 8, state police took Gregory Luppert, 50, of South Valley, into custody for felony driving while intoxicated. Lippert was pulled over on Frew Run Road in Frewsburg for a traffic violation and was found to be intoxicated. He was transported to the New York State Police barracks in Jamestown where he refused to provide a breath sample. A check of Lippert’s driving record revealed he had been convicted of DWI within the last 10 years, therefore the charge was upgraded to a felony. Lippert was then processed, arraigned in the Town of Carroll Court and remanded to Chautauqua County Jail.
ELLICOTT POLICE DEPARTMENT
Michael R. Degolier, 27, of South Work Street, Falconer, was charged with forcible touching, endangering the welfare of a child and unlawful imprisonment. Police on Dec. 31 were contacted by a female victim of a domestic incident that occurred in Falconer. The victim said she went to her ex-boyfriend’s apartment to pick up their 11-month-old baby. Degolier then placed the baby in another room of the apartment and forced the victim onto the couch and forcibly touched her. When the victim attempted to leave, Degolier restrained her on the couch, preventing her from leaving on her own free will. Degolier was picked up at a later time on a warrant and was remanded to Chautauqua County Jail.
Angela L. Person, of North Dow Street, Falconer, was issued appearance tickets for taking $38.40 worth of merchandise from a Dollar General without paying. Person will be in Town of Ellicott Court at a later date.
Ronald C. Greene, 22, was charged with endangering the welfare of a child and second-degree harassment. Police on Dec. 29 took Greene into custody after a domestic dispute, during which Greene had a physical altercation and threw a television, nearly striking a child. He was arraigned and remanded to Chautauqua County Jail.

Carole Tamayo, 47, of Jamestown was charged with disorderly conduct and resisting arrest. Police on Tuesday responded to 25 Price St. when Tamayo allegedly became irate, yelling and using obscene language in public. Officers attempted to arrest her for disorderly conduct, however, Tamayo became physically resistant and noncompliant. She was eventually taken into custody and placed in Jamestown City Jail.
Steven W. Hallmark, 26, of Jamestown was charged with second-degree obstructing governmental administration and resisting arrest. At 2:26 a.m. Wednesday, officers responded to the area of 188 Falconer St. for a reported fight. When officers arrived, they could hear a physical altercation inside the upper apartment. The occupants of the apartment refused to answer the door. Police were required to use force to enter the apartment. As officers were entering the apartment, Hallmark allegedly attempted to flee by exiting a window and jumping off the roof. He encountered officers outside, at which time he physically resisted arrest. He was transported to Jamestown City Jail and is currently being held awaiting arraignment.
Kristine McCool, 27, of Falconer Street, Jamestown was charged with four counts of endangering the welfare of a child and unlawful growing of cannabis. Police on Wednesday responded to reports of a fight. Upon arrival, officers could hear a physical altercation inside the upper apartment. Officers used force to enter the apartment and found McCool inside the back bedroom. She was allegedly highly intoxicated and unable to care for her children, all of whom were inside the apartment. Further investigation discovered a small marijuana growing operation. McCool was transported to Jamestown City Jail, and is being held without bail awaiting arraignment.

DUNKIRK – Brenda L. Carter-Ducett, 50, of Deer Street, was charged with criminal possession of a controlled substance in the third-degree and criminal sale of a controlled substance in the third-degree. Carter-Ducett was located in Buffalo and was arrested on a Chautauqua County Court secret grand jury indictment warrant. The warrant had been issued after the district attorney presented an investigation from the Southern Tier Regional Drug Task Force to a grand jury. It is alleged Carter-Ducett had been selling quantities of crack cocaine from her Dunkirk residence. She was transported to City of Dunkirk Jail for processing before being taken Chautauqua County Jail to wait arraignment.
CATTARAUGUS COUNTY SHERIFF’S OFFICE
DELEVAN – Suzanne E. Holland, 29, of Cobb Avenue, was charged with welfare fraud in the third-degree, grand larceny in the third degree and three counts of offering a false instrument for filing in the first degree. Holland allegedly failed to report that her boyfriend, who had income, was living in her household on the applications she submitted to the county Department of Social Services from February 2010 through August 2010. Holland received $3,838.50 in cash assistance and food stamps at that time.
EASTON, Pa. – Stephanie Almond, 34, was taken into custody Tuesday by the Cattaraugus County Sheriff’s Office on a fugitive from justice warrant out of Pennsylvania. She was remanded to the county jail without bail where she will be held for 30 days or until she is extradited back to Pennsylvania.
ALLEGANY – Gayle A. Peterson, 53, of North Second Street, was charged with harassment in the second-degree and stalking in the fourth-degree. Peterson was charged on Monday following an incident that occurred in the town of Allegany. She will appear in court at a later date.

MAYVILLE – Andrew W. Campaign, 39, of Fredonia was wanted for assault and driving while intoxicated. Campaign turned himself into county court, and was arraigned and remanded to the Chautauqua County Jail. He has been removed from the Chautauqua County wanted list.
STOCKTON – Steven J. Stablewski, 22, of Stockton was wanted for assault and driving while intoxicated. According to police, deputies and members of the New York State Police responded to West Railroad Avenue in Stockton on a report that Stablewski was at a residence there. Stablewski had several outstanding warrants and was taken into custody without incident. He was remanded to the Chautauqua County Jail and removed form the Chautauqua County wanted list.
POMFRET – Thomas Fitzgerald, 64, of Angola was charged with driving while intoxicated and failure to keep right at 1:13 a.m. Sunday. According to police, Fitzgerald was stopped after he was observed crossing the center line. Further investigation led to the charge of driving while intoxicated. He was issued tickets and is to appear in court at a later date.
HANOVER – Keith R. Parmenter, 40, of Salamanca was charged with inadequate tail lamps and third-degree aggravated unlicensed operation of a motor vehicle at 7:40 p.m. Monday. He was issued traffic tickets and will appear in court at a later date.

GOWANDA – Victoria J. Mercado, 49, of Gowanda was taken into custody on a bench warrant issued by the town of New Albion at 8:25 p.m. on Jan. 1. She was arraigned and remanded to the Cattaraugus County Jail in lieu of $100 bail.
COLDSPRING – A 17-year-old female and an 18-year-old male have both been charged with second-degree criminal trespassing at 3:36 a.m. Monday. The female was processed and released with an appearance ticket. The male was arraigned and remanded to the Cattaraugus County Jail in lieu of $1,000 bail. Both individuals will be in court at a later date.
GOWANDA – Frank H. Hawkins Jr., 22, of Gowanda was taken into custody on a bench warrant issued by the city of Salamanca at 6 p.m. Friday. He was held pending further action.

GREAT VALLEY – Clint J. Crouse, 27, of Salamanca was charged with second-degree harassment at 2:45 a.m. Friday. According to police, Crouse allegedly struck a juvenile female in the face early Friday morning. He was issued an appearance ticket to be in court later.

Corey P. Reichardt, 20, of Lakewood was charged with unlawful possession of marijuana and second-degree criminal contempt. Police on Saturday pulled Reichardt over in his vehicle for having only one working headlight and a female subject who was riding in the front seat and had a valid order of protection against the driver. After a search of Reichardt and his vehicle, officers located a quantity of marijuana. He was issued an appearance ticket and will appear in court at a later date.
Richard R. Blose, of Ashville was charged with driving while intoxicated, DWI per se and leaving the scene of a property damage accident. Police on Saturday at 2:56 a.m. stopped a vehicle on Shadyside Road in the village of Lakewood. Upon investigation, it was found Blose was intoxicated.
James D. Surrena, 42, of Prospect Avenue, Jamestown, was charged with issuing a bad check. A warrant was served on Surrena for issuing the bad check, presented to Bob’s Liquor on Nov. 3. The warrant was sent to Chautauqua County Jail, where Surrena was being held on other charges. He is due in Town of Busti Court on Jan. 10 for arraignment.
CHAUTAUQUA COUNTY SHERIFF’S OFFICE
Frank Orazio, 22, Spencer Burke, 19, and Justin Burke, 23, all of Stockton were charged with fifth-degree criminal possession of stolen property. Police were conducting an investigation into a reported larceny that occurred in the town of Charlotte on Dec. 15. The investigation led to the arrest of the three suspects after the reported stolen property was found in their possession. All three were issued appearance tickets and are to appear in Stockton Court at a later date.
NEW YORK STATE POLICE
On Dec. 23, 2012, Troopers responded to a residence in the town of Panama for a report of a violation of an order of protection. Investigation revealed that the suspect, Joshua Phanco, 20, of Lakewood, contacted the victim several times by phone, thus violating the court order. Phanco was arrested for second-degree criminal contempt, processed and released with an appearance ticket returnable to the Town of Harmony Court.
On Jan. 5, 2013, Troopers arrested Mark Johnson, 31, of Ellington, for driving while intoxicated. Johnson was pulled over on East Second Street in Jamestown for multiple traffic violations, and after failing several field sobriety tests, he was placed under arrest. Johnson was transported to the State Police barracks in Jamestown, where he provided a breath sample of .14 percent. He was then processed, issued tickets returnable to the City of Jamestown Court, and released to a sober individual.

PORTVILLE – Ezra L. Johnson, 21, of Olean, was charged at 4;16 p.m. on Dec. 25 with harassment second, reckless endangerment second and endangering the welfare of a child following a domestic dispute that occurred in the town of Portville. Johnson was issued an appearance ticket and will appear in court at a later date.
ALLEGANY – Patrick M. Carpenter, 28, of 30 Keaton Ave., Bradford, was arrested at 8 a.m. on Tuesday on a McKean County, Pa. warrant after he was found walking on Interstate 86 in Allegany. He was also charged with unlawful possession of marijuana. Carpenter was transported to the town of Salamanca Court for an arraignment and was remanded to the Cattaraugus County Jail until he is transferred over to the McKean County Sheriff’s Office.

KIANTONE – Thomas R. Ciancio, 57, of Bemus Point, was charged at 9:02 p.m. on Thursday with driving while intoxicated and moving from lane unsafely. Sheriff’s deputies responded to a report of a vehicle off the road in the ditch on Route 62 in the town of Kiantone. Following an investigation, deputies reported that Thomas R. Ciancia was operating a northbound 2004 Chevy Impala. It is alleged that Ciancio was operating in an intoxicated condition and was arrested for driving while intoxicated. He was taken into custody and refused a chemical breath test. He was released with appearance tickets and will appear in Kiantone town court at a later date.
SINCLAIRVILLE – Scott T. Fisher, 22, of 28 Park St., Sinclairville, was charged at 9:25 p.m. on Thursday with criminal possession of stolen property fifth. Deputies responded to a Sinclairville residence to check for a wanted subject. Scott T. Fisher was arrested on a town of Harmony warrant for criminal possession of stolen property fifth, was arraigned in the town of Sherman and remanded to the Chautauqua County Jail.
CHERRY CREEK – Joseph C. Gierszewski, 19, of South Dayton was charged with unlawful possession of marijuana, unlawful possession of alcohol by a minor, failure to keep right and moving from lane unsafely Saturday. County sheriff’s deputies stopped a vehicle on Route 83 at 12:23 a.m. after they observed the vehicle travel off the road and back on. Gierszewski was identified as the operator and following an investigation was charged. He was released with appearance tickets for Cherry Creek Town Court at a later date.

William D. White of Jamestown was charged with second-degree criminal contempt Thursday at 7:23 p.m. Officers responded to a call to check the well being of a subject inside the garage at 25 Regent St. Officers located White, who has a valid Jamestown City Court order of protection on him to stay away from the residence. White was charged and taken to Jamestown City Jail without incident. He was being held pending arraignment.
21-year-old Malcolm B. Bull was charged with tampering with physical evidence and third-degree criminal possession of a controlled substance Friday. Jamestown police officers and county sheriff’s deputies executed a traffic stop at 8:16 p.m. in the intersection of Fluvanna Avenue and Washington Street. Upon further investigation, officers found 14 grams of methamphetamine in Bull’s vehicle. He was taken into custody and transported to Jamestown City Jail without incident.

Marcus Beckwith-Kaiser, 22, of Fredonia was charged with third-degree aggravated unlicensed operator, suspended registration, unlicensed motor vehicle and expired inspection Tuesday. Westfield officers observed a vehicle with an expired inspection sticker on East Main Street in the village at 4:36 p.m. Upon further investigation, Beckwith-Kaiser was identified as the operator as issued traffic citations. He will appear in Westfield Village Court at a later date.
Wendy Blakeslee, 32, of Westfield was charged with third-degree aggravated unlicensed operation Tuesday. Officers stopped Blakeslee on East Main Street in the village with specific knowledge that her driving privileges were suspended in New York state. She will appear in Westfield Village Court at a later date.

CATTARAUGUS COUNTY SHERIFF’S OFFICE
Courtney L. Crouse, 19, of Center Road, Salamanca was charged with second-degree assault, third-degree assault and endangering the welfare of a child. Crouse was taken into custody on Tuesday during a domestic violence incident after allegedly hitting her boyfriend in the head with a shovel. Crouse was also discovered to have a previous arrest warrant stemming from an assault. She was arraigned at Town of Salamanca Court, was released on her own recognizance for the warrant and was remanded to Cattaraugus County Jail without bail for the domestic violence incident.
Glenn W. Miller, 45, of Salamanca was charged with aggravated driving while intoxicated, first-degree aggravated unlicensed operation and felony driving while intoxicated. Deputies took Miller into custody based on a Dec. 28 incident in Salamanca. He was arraigned in City of Salamanca Court and remanded to Cattaraugus County Jail in lieu of $2,500 bail. Miller will appear back in court at a later date.

CHAUTAUQUA COUNTY SHERIFF’S OFFICE
Deputies on Tuesday responded to Stebbins Road in the town of Hanover for a report of a car accident. Investigation revealed that a 17-year-old female from Silver Creek was operating the vehicle westbound on Stebbins Road and lost control of the vehicle, which struck a stump and some small trees. The vehicle then rolled and came to rest on its wheels in a lawn. The driver was transported by a private vehicle to Lakeshore Hospital with minor injuries. It appeared that speed not safe for conditions contributed to the accident.
Deputies on Dec. 31 were investigating a reported burglary on North Erie Street in the village of Mayville. During their investigation they discovered the possible entry into a residence. A subsequent search of the residence by a K-9 dog found two juveniles hiding within the residence. A 16-year-old male was issued an appearance ticket for trespassing and will appear in Town of Chautauqua Court at a later date. Police say the juveniles were not involved in the initial burglary reported.
CATTARAUGUS COUNTY SHERIFF’S OFFICE
George B. Varner, 45, of Columbia was charged with disorderly conduct and trespassing. Deputies on Dec. 25 arrested Varner after causing a disturbance at the Seneca Allegany Casino in Salamanca. He was told to leave the casino but later returned and continued to use loud vulgar language toward deputies and security. Varner was arraigned at City of Salamanca Court and posted bail to return at a later date.
NEW YORK STATE POLICE
Justin Pelsey, 20, of McAllister Road, Fredonia, was arrested Dec. 28 for unlawful possession of marijuana. Troopers said Pelsey was stopped in his vehicle for having an inadequate turn signal in town of Pomfret. He will answer the charges in Town of Pomfret Court on Jan. 8.

CHAUTAUQUA COUNTY SHERIFF’S OFFICE
David J. Frank, 21, of Dunkirk was charged with moving from lane unsafely, unlicensed driver, unregistered motor vehicle, driving while intoxicated and DWI with blood alcohol content greater than .08 percent. Deputies on Tuesday were investigating a suspicious situation on Roberts Road in the town of Dunkirk. During that investigation, a vehicle was located in the snow bank at the end of the road. Frank was found to be intoxicated and was placed under arrest without incident. He was processed and released with traffic tickets and will appear in court at a later date.

Michael J. Anderson, 40, of Jamestown was arrested Thursday morning after he was located walking down Peck Hill Road. His car was reportedly parked illegally on Lincoln Avenue, hindering a town snowplow. Anderson was found to be carrying a gym bag containing tools commonly used for scrapping metal. He was processed and charged with criminal trespass in the third degree, possession of burglar’s tools and unlawful possession of marijuana. Anderson was released on appearance tickets and traffic tickets and is to appear in Town of Perrysburg Court at a later date.
JAMESTOWN POLICE DEPARTMENT
Scott C. Olson, 58, of Jamestown was charged with second-degree criminal trespass and second-degree aggravated harassment. Police on Tuesday at 7 a.m. responded to 48 Sturges St. to investigate a domestic violence incident. The investigation revealed that Olson had entered the female victim’s residence uninvited and began to yell and scream at her. Olson then left the residence and placed multiple phone calls to the victim in which he screamed profanities at her. He was located by police at his residence a short time later and was taken into custody. Olson was transported to Jamestown City Jail, arraigned in City Court and released to appear at a later date.
Amy Baker, 30, of Celoron was charged with driving while intoxicated. Police on Tuesday at 12:17 a.m. came across a single-car accident near the intersection of Jones and Gifford and Lister avenues. Police say Baker lost control of her vehicle, drove off the roadway and ended up in the ditch. During their investigation, officers determined Baker was intoxicated.
