Salamanca Teacher Sees Second Sex Abuse Claim

SALAMANCA — A second student has come forward claiming sexual abuse by a former Salamanca City School District teacher.

A claim was filed Thursday in state Supreme Court in Cattaraugus County by a student who claims Michael DuPont, a former teacher in the school district, allegedly began abusing the youth in the 2002-03 school year when the youth was in seventh grade. The Salamanca City School District is also named in the lawsuit.

It is alleged DuPont used a questionnaire that the teacher had developed for children in his class to learn information about students. DuPont allegedly singled the youth out and gave him additional attention, visiting the youth’s home to build trust with the child’s mother so DuPont could take the youth to the movies and for ice cream and allowing the youth to take DuPont’s laptop computer to the youth’s house since the youth didn’t have a computer at home.

The youth alleges DuPont showed the youth pornography during class featuring young boys engaged in sexual acts, that the teacher would touch the boy intimately during class while other students were in the room and that DuPont allegedly arranged to have the youth in the classroom alone to sexually abuse the youth. The youth also alleges DuPont took the youth into a closet in DuPont’s classroom and tried to escalate the sexual abuse, though the youth allegedly resisted the advances. The youth alleges several male students were taken into the closet at the same time.

“At no time during the forced sexual activity described herein did (the youth) provide consent to engage in these acts with DuPont,” attorneys Michael Rose and Hillary M. Nappi of Hach, Rose, Schirippa and Cheverie LLP of New York City wrote in the lawsuit. “At no time in the year of forced sexual activity described herein could (the youth) legally provide his consent to engage in these acts with DuPont.”

The former student is asking for compensatory damages, punitive damages, interests and costs. An exact dollar amount is not listed in the lawsuit.

Many of the allegations against DuPont are similar to a case filed in September by another former student, including use of a questionnaire to select youth with whom the teacher could become close and showering the youth with affection.

DuPont was sentenced in 2009 to serve up to 14 years in prison after he was convicted of two counts second-degree sodomy and two counts of disseminating indecent materials to minors. He was forced to relinquish his teaching license. He is listed as a Level 3 sex offender on the state Sex Offenders’ Registry.
