A Frewsburg, N.Y., man was briefly jailed last week after allegedly pointing a firearm at a driver on Route 6 on Thursday during a road rage incident – with both drivers blaming the other for the incident.
Timothy J. Prince, 67, was charged with two counts of second-degree felony aggravated assault – attempts to cause or causes bodily injury with a deadly weapon, two counts of misdemeanor terroristic threats causing serious public inconvenience, two counts of misdemeanor simple assault and two counts of harassment on Thursday, Oct. 29, after the State Police at Warren responded to a report of a firearm being pointed at a motorist on Route 6 in Sheffield. A man said he pulled onto Route 6 ahead of a motorcycle and saw the motorcycle and a car in his rear view mirror as he approached an active school zone on Route 6. The driver said as the school zone ended the motorcycle approached and passed on the left, with the rear passenger on the motorcycle flipping the driver off. The driver said that he was then driving behind the motorcycle, which was traveling slowly, and that he approached and passed the motorcycle before the motorcycle rider then began a second pass of the vehicle. As the motorcycle passed the vehicle the second time, the driver said the motorcyclist allegedly removed a firearm from his front pocket and pointed it at the driver. The driver then said the motorcycle rider allegedly pointed the firearm at him a second time. The driver’s son was in the passenger seat of the vehicle during the incident.
Warren city police officers saw the motorcycle traveling west on Pennsylvania Avenue in Warren a short time later and pulled it over. Prince, according to the Affidavit of Probable Cause, said a road rage incident began in the Sheffield area on Route 6 and allegedly admitted to retrieving a gun and pointing it at the operator of the truck because Prince felt the truck was attempting to run him off the road. Prince allegedly told police he was acting in self-defense. Police reported finding a handgun in plain view on the motorcycle.
“By pointing a firearm at another motorist from an adjacent lane during a moving traffic dispute, Prince put both victims in fear of imminent serious bodily injury, communicated a threat to commit violence with intent to terrorize another and did attempt to cause bodily injury with a deadly weapon,” the affidavit states.
Prince was arraigned Thursday by Magisterial District Judge Laura Bauer, who set bail at $10,000. Bond was posted Friday morning, according to online court docket information. A preliminary hearing is scheduled for Nov. 4.
