A Frewsburg man was charged three times in six days, including a stalking charge after allegedly calling a woman 200 times in violation of a stay away order of protection.
Mitchell A. Costanzo, 32 , of Frewsburg, was charged with fourth-degree stalking, second-degree aggravated harassment, first-degree criminal contempt and aggravated family offense at 12:30 a.m. July 11 after Ellicott police officers responded to a past-tense domestic incident where it is alleged Costanzo called a woman more than 200 times, violating a complete stay away order of protection that was in place. Costanzo was taken into custody on an outstanding warrant and taken to the Chautauqua County Jail for arraignment.
Costanzo was then charged twice in less than an hour on July 17 by Ellicott police officers. In the first incident, Costanzo was charged with second-degree aggravated harassment, first-degree criminal contempt and aggravated family offense at 9:30 p.m. July 17 after officers to a past-tense domestic incident where it is alleged that Costanzo called a woman, violating a complete stay away order of protection that was in place Costanzo was also allegedly seen by a witness driving past the woman's home several times. Costanzo was taken into custody on an outstanding warrant and taken to the Chautauqua County Jail for arraignment.
Then, at 10:20 p.m. July 17, Costanzo was again charged with second-degree aggravated harassment, first-degree criminal contempt and aggravated family offense after police responded to another past-tense domestic incident where it is alleged Costanzo contacted a female victim, via phone, violating a complete stay away order of protection. Costanzo was taken into custody on outstanding warrants and taken back to the county jail for arraignment.
Costanzo will be in Ellicott Town Court later.
Costanzo had also been charged July 2 at 10:04 a.m. with fourth-degree criminal mischief, second-degree unlawful imprisonment, second-degree harassment, driving while intoxicated, driving while intoxicated with a BAC of .08% or more, third-degree aggravated unlicensed operation and driving on a sidewalk on July 2 at 10:04 a.m. after officers responded to a reported domestic dispute in progress.
It’s alleged Costanzo drove to a person’s house and blocked the driveway with his vehicle in a way that the other person could not leave to get away from him. Costanzo allegedly engaged in a physical altercation with the person and damaged property belonging to the other person. Through investigation officers determined that Costanzo allegedly operated the vehicle while intoxicated and with a revoked driver’s license. Costanzo was taken to the Chautauqua County Jail for centralized arraignment and issued traffic tickets following the incident.
