Solar Company Submits Wetlands Permit Application

York Run Solar, LLC recently filed a joint application with the U.S. Army Corps of Engineers for a wetlands permit which includes a submission of a water quality certification to the New York State Office of Renewable Energy Siting and Electric Transmission.

The York Run Project is in the towns of Busti and Kiantone.

In April 2025, Gov. Kathy Hochul announced (ORES) had issued final siting permits to develop York Run Solar, a 90 megawatt (MW) solar facility in the towns of Kiantone and Busti.

“On Earth Day, New York is proud to announce its latest investment in solar and wind technology, upholding our commitment to build a clean energy economy,” Governor Hochul said in April. “With refined siting protocols through the establishment of ORES four years ago, New York is expediting permitting for clean energy projects – all while creating good-paying jobs throughout the state. These projects are a testament to New York’s commitment to sustainability and resiliency in the face of a changing climate.”

There were also a 20 megawatt and a 40-megawatt solar project elsewhere in the state that were approved as well.

In a March 13 advertisement, York Run Solar said the application includes a description of the project, including details on project components, project design, project construction, and related information; analysis of the environmental setting of the project; results from analyses conducted to assess potential impacts to aquatic resources, streams and jurisdictional waters from construction and operation of the project; proposed measures to minimize environmental impacts; and reasonable alternatives. The pending application also addresses compliance with the Endangered Species Act, and Historic Preservation Act. In general, the project is anticipated to have minimal permanent federal wetland impacts and impacts to federally regulated streams.

In February 2025, a public hearing was held in Kiantone, where only one person spoke out in opposition.

In 2023, the Busti Town Board approved two resolutions regarding a planned 8-megawatt solar farm at 1192 Orr St. The first was to issue a negative declaration pursuant to the State Environmental Quality Review Act while the other was to approve a special use permit for SL Jamestown LLC to construct and operate the “large-scale solar energy system” on the 27.56-acre site.

At that time, Town Board Member Todd Hanson recused himself on the resolution and council member Paul Gustafson voted no to each.

In June 2025, the board approved the extension of three moratoriums. The board passed Local Law No. 1, entitled, A Local Law Enacting a Moratorium on Commercial Solar Energy Facilities; Local Law No. 2, entitled, A Local Law Enacting a Moratorium on Wind Energy Conversion Systems and Local Law No.3, entitled A Local Law Enacting a Moratorium on Battery Energy Storage Systems. The recent approval of three moratoriums extends the suspension period for land use activities until May 31, 2026.
