Stow Business Banned From Selling Tobacco For One Year
A business in Stow has been temporarily suspended from selling lottery and tobacco items due to selling products to underage individuals.
During the Chautauqua County Board of Health meeting, it was announced that Hogan’s Hut on Old Bridge Road was fined $1,250 for a second violation of the state’s Tobacco Enforcement Program, where the business sold tobacco products to an individual under 21 years of age. The business was also fined an additional $250 required surcharge, bringing the total to $1,500.
The business owners chose not to take their accusation to court and instead agreed to pay the fine.
In addition to the fine, Jessica Wuerstle with the county Health Department announced that the county was recommending the business get a one-year suspension.
The Board of Health’s meeting was on Jan. 15. Wuerstle said in a follow up interview that the state Department of Taxation and Finance agreed to suspend Hogan’s Hut’s license, which includes not only tobacco but also lottery tickets.
Wuerstle said the Health Department must monitor Hogan’s Hut to ensure it does not sell any type of tobacco, including vape and smokeless tobacco products. “As long as they comply with the suspension, then it will be lifted after a year. If for some reason they are not complying, that is the point in which we would move forward with recommending a license be completely revoked,” she said.
Along with Hogan’s Hut, Cloudz City, LLC, located at 51 East Main St. Westfield was cited for selling tobacco products to an underage individual. This was the business’ first fine.
Cloudz City was fined $400 plus $250 required surcharge, bringing the total to $650.
