City Man Faces Extradition From Warren County
A Jamestown man charged Oct. 17 with retail theft in Conewango Township faces extradition.
Marcellino Hernandez, 44, of Jamestown was charged with retail theft – taking merchandise, use/possession of drug paraphernalia and false identification to a law enforcement officer Oct. 17 by Conewango Township police officers after an alleged incident Oct. 16 in the city of Warren. Bail was set at $50,000 by Magisterial District Judge Raymond Zydonik and Hernandez was taken to the Warren County Jail until he could post bail. A preliminary hearing is scheduled in Zydonik’s court on Oct. 29.
Bail was later increased to $75,000 after extradition proceedings began on Tuesday. An extradition hearing will be held at 10 a.m. Nov. 6 in front of Judge Gregory Hammond in the Court of Common Pleas.
Hernandez has faced several charges in Jamestown in recent months, according to a review of The Post-Journal’s archives.
In June, Hernandez was charged with resisting arrest, seventh-degree criminal possession of a controlled substance and operating an electric scooter on a sidewalk after officers allegedly saw Hernandez riding a scooter and allegedly committed traffic violations. Officers attempted to conduct a street check, in which Hernandez then disregarded verbal commands to stop and attempted to flee into a backyard. After a very brief pursuit, officers were able to catch Hernandez. While placing Hernandez into custody, he continued to disregard verbal commands and resist officers. Hernandez was quickly taken into custody without further incident, where he was also found to be in possession of a quantity of fentanyl. Hernandez was transported to Jamestown City Jail, where he was held pending arraignment.
In July 2024 Hernandez was charged with resisting arrest, seventh-degree criminal possession of a controlled substance and other violations after fleeing officers who saw him riding a bicycle on a sidewalk. Officers had prior knowledge that Hernandez had outstanding warrants out of Jamestown Police Department. Officers initiated a vehicle and traffic stop on Hernandez with emergency lights and sirens. He proceeded to flee on his bicycle. Officers pursued Marcelino onto Pine Street and toward an alley in the area. Officers exited the marked patrol unit and pursued Marcelino on foot toward East Fourth Street. Hernandez was taken into custody shortly after and transported to the city jail. Marcelino also was allegedly found to be in possession of suboxone sublingual films, which are a controlled substance.
In May 2024, he was charged with seventh-degree criminal possession of a controlled substance and taken to the Jamestown City Jail on an arrest warrant after an officer patrolling in the area of Prendergast Avenue and East Eighth Street saw Hernandez riding a bicycle south on Prendergast Avenue on the sidewalk. The officer knew Hernandez had an active warrant out of Jamestown Police Department. Marcelino was located nearby on North Main Street. He was searched and was allegedly in possession of a quantity of cocaine. He was released with an appearance ticket.
In February 2024, Hernandez was charged with fourth-degree criminal possession of a controlled substance, second-degree criminally using drug paraphernalia and four counts of seventh-degree criminal possession of a controlled substance after officers saw fire coming out of a tent next to two homes on the north side of Jamestown at 4:12 a.m. Hernandez had allegedly started the fire, which violated Jamestown City Code for prohibited burning within the city, and was allegedly found with a quantity of methamphetamine, cocaine, suboxone, and packaging materials. He was transported to Jamestown City Jail until he could be arraigned and was later released.
