Oral Arguments Canceled In City Police Arbitration Case

Oral arguments scheduled to be heard in the arbitration case involving the city and its police union have been canceled, but the court will still make a decision at a later date.

Justices with the New York State Supreme Court Fourth Judicial Department Appellate Division were scheduled to hear oral arguments from Kendall Club Police Benevolent Association attorney Charles DeAngelo of Fessenden Laumer & DeAngelo and Terence Michael O’Neil of Bond, Schoeneck & King, who is representing the city. But the case, like several others, was not heard on March 30 because of the novel coronavirus, COVID-19, outbreak.

However, according to a letter the court posted on its website and sent to representatives of all cases to be heard by the court during its March-April session, the oral arguments may have been canceled, but the court will still make a decision based on the submissions given to the Appellate Division.

DeAngelo said he fully understands the court’s decision to cancel the oral arguments.

“On a typical day, they will hear 20 to 30 different cases. Having that many attorneys coming in and out of the court house risking the health of the court, their staff and the general public is clearly not appropriate,” DeAngelo said. “As the court has 3,999-page hearing record and three court briefs to consider, which were submitted by the parties, the Kendall Club PBA fully understands the court’s decision.”

Elliott Raimondo, city corporation counsel, said city officials received a letter from the Appellate Court toward the beginning of March explaining that oral arguments would be canceled, but the court will still be making a decision on the case.

“It was set to be an interesting oral argument,” he said.

Raimondo said city officials anticipate a decision by the court in June.
