Jamestown Brewing Company To Open In July

The new brewery and restaurant in Jamestown has set an opening date.

According to the Jamestown Brewing Company Facebook page, the new brewery and restaurant located at 119 W. Third St. will be opening Friday, July 12. The message said, “PSA: We’re back and we’ve got news. We want to thank you for your patience over the past few months. We love our loyal fans and appreciate you sticking around.”

In recent months the construction of the brewery has been slowed by litigation between the developers of the brewery and restaurant — father and son team of Jon McLellan and Jon McLellan II — and the redeveloper and owner of the former W.T. Grant Building — GPatti Enterprises.

Earlier this month, a conditional certificate of occupancy had been issued to GPatti Enterprises to allow the developer and its tenant, Jamestown Brewing Company, access to the building to prepare for the opening of the brewery, restaurant and banquet facility. Occupancy of the building was one of the issues discussed during oral arguments of Jamestown Brewing Company’s lawsuit against GPatti Enterprises in mid-April.

Attorneys for the entities will be in court again in mid-June for a conference on the two remaining claims from the original lawsuit filed by Jamestown Brewing Company. Three of the claims were dismissed by the judge, with the remaining claims focusing on a breach of contract between the parties and a claim centered around an accounting of Downtown Revitalization Initiative funds.

Last month, GPatti Enterprises filed its responses to the remaining claims by Jamestown Brewing Company while also asserting several counterclaims against the brewers. GPatti is asking state Supreme Court in Erie County to dismiss the remaining two claims against it while filing four counter-claims.

Earlier this month, Jamestown Brewing Company answered GPatti’s counterclaims by asking the court to dismiss the arguments.
