Delevan Man Sentenced In Sex Crimes Incident

LITTLE VALLEY–A Delevan man who broke into a Yorkshire home last year and committed a sex act was sentenced Monday in Cattaraugus County Court.

Brandon D. Root, 29, was sentenced to two concurrent terms of six years in state prison plus five years of post-release supervision for his convictions of first-degree rape and first-degree criminal sexual act.

The charges stem from an April 9 incident in Yorkshire, in which Root reportedly broke into a home, engaged in sexual intercourse with another person by force, engaged in oral or anal sexual contact by force and caused physical injury.

Other individuals sentenced Monday included:

Ryen T. Putt, 25, of Olean, who was sentenced to 12 weekends in the Cattaraugus County Jail and five years of probation for his conviction of two counts of fourth-degree grand larceny, a class E felony. The charge stems from incidents that occurred between July 3 and July 13 in Portville, in which Putt stole property consisting of one or more firearms, rifles or shotguns.

Jeffrey Burney, 22, of Olean, who was sentenced to 60 days in the Cattaraugus County Jail and three years of probation for his conviction on third-degree assault, a class A misdemeanor. The charge stems from a March 11 incident in Olean, in which Burney, along with a co-defendant, injured another person.

Allen E. Brillhart, 31, of Silver Creek, who was sentenced to five years of probation for his conviction of driving while intoxicated, a class E felony. The charge stems from a Nov. 9, 2015, incident in Persia, in which Brillhart drove a vehicle while intoxicated and with a child less than 15 years old as a passenger.

Individuals that pleaded guilty Monday included:

Maurice Arnold, 29, of Hinsdale, who pleaded guilty to third-degree attempted criminal sale of a controlled substance, a class C felony. The charge stems from a June 21 incident in Olean, in which Arnold allegedly attempted to sell a controlled substance. Sentencing is scheduled for March 13.

Rachel Slawiak, 26, of Olean, who pleaded guilty to fourth-degree criminal sale of a controlled substance, a class C felony. The charge stems from a Jan. 8, 2016, incident in Olean, in which Slawiak unlawfully sold a controlled substance. Sentencing is scheduled for March 13.

Andrea Stanczykowski, 29, of Olean, who pleaded guilty to third-degree attempted criminal sale of a controlled substance, a class C felony. The charge stems from a May 31 incident in Olean, in which Stanczyowski attempted to sell a controlled substance. Sentencing is scheduled for Jan. 18.

Individuals who pleaded not guilty Monday included:

Mary P. Erhart, 36, who pleaded not guilty to third-degree criminal sale of a controlled substance, a class B felony. The charge stems from a Sept. 17 incident in Olean, in which Erhart allegedly sold a controlled substance. The case has been adjourned for motions.

Nathan C. Bilby, 25, of Olean, who pleaded not guilty to two counts of fourth-degree grand larceny, a class E felony; and seven counts of petit larceny, a class A misdemeanor. The charges stem from an Aug. 20 incident in Olean, in which Bilby allegedly stole property. The matter has been adjourned for motions.

Ryan P. Willis, 33, of Portville, was pleaded not guilty to two counts of third-degree unlawful manufacture of methamphetamine, a class D felony; second-degree criminal possession of methamphetamine materials, class A misdemeanor; and second-degree criminal possession of a controlled substance, a class A2 felony. The charges stem from a July 29 incident in Portville, in which Willis unlawfully possessed materials to produce, prepare or manufacture methamphetamine. The matter has been adjourned for motions.
