Dunkirk Man Sentenced For Threatening Co-Workers With Gun

A Dunkirk man accused of threatening his co-workers with a gun last year is heading to state prison.

On Monday, Patrick Swanson, Chautauqua County district attorney, announced that Rolando Rivera-Santos, 42, was handed a determinate sentence of three years in state prison plus five years of post-release supervision for a conviction of second-degree criminal possession of a weapon.

The charge stems from an incident on Sept. 15, in which Rivera-Santos, then an employee of Fieldbrook Foods plant, displayed a handgun in a threatening manner toward his co-workers.

Police confronted Rivera-Santos and were able to seize his weapon, a .380-caliber semi-automatic pistol from his back pocket. As a convicted felon, he was not entitled to possess any firearm.

Rivera-Santos was sentenced on May 25 by the Hon. David Foley, Chautauqua County Court judge.

Swanson also announced that Devonte Chandler, 25, of Dunkirk, was sentenced to concurrent determinate sentences of two years in state prison plus one year of supervision for three counts — two counts of fifth-degree criminal sale of a controlled substance and one count of third-degree criminal possession of a controlled substance.

The charges stem from an arrest on Jan. 27 in Jamestown, in which police executed a search warrant at 323 Newland Ave. and found Chandler with 58 bags of heroin.

Chandler was sentenced on May 25.

Other individuals recently sentenced included:

Nicholas A. Tobin, 33, of Erie, Pa., who was handed a determinate sentence of two years in state prison plus 1 1/2 years of post-release supervision for a conviction of second-degree assault and an indeterminate sentence of 1-3 years in state prison for first-degree criminal contempt. The sentences are to run concurrently.

Jared Leroy, 37, of Jamestown, who was handed a determinate sentence of five years in state prison plus three years of post-release supervision for a conviction of second-degree assault.

Jacob M. Smith, 26, of Jamestown, who was handed a determinate sentence of three years in state prison plus five years of post-release supervision for a conviction of second-degree assault and an indeterminate sentence of 1 1/2 to three years in state prison for a conviction of second-degree attempted assault.

Omar Rosado, 31, of Jamestown, who was handed a determinate sentence of three years in state prison plus two years of post-release supervision for a conviction of third-degree criminal sale of a controlled substance.

Alexander Tywalk, who was handed an indeterminate sentence of 2-4 years in state prison for a conviction of third-degree burglary.
