Confusing Fireworks Law Needs A Rewrite

If possible, the Chautauqua County Legislature should rethink its support of legislation that made the sale and use of sparkling devices legal in Chautauqua County.

Jamestown police responded to 57 complaints of illegal fireworks from July 1-6, though most of the complaints were deemed unfounded because no one was around when officers arrived. Multiple warnings were also given out, according to Jamestown Police Capt. Robert Samuelson, which indicates that perhaps the law, as written, is confusing. Both Samuelson and Chautauqua County Sheriff Joe Gerace told The Post-Journal last week that the county’s law is confusing and unenforceable.

“(The law) opens it up to a lot of different type of devices in all shapes and sizes,” said Gerace, in an earlier interview. “We receive a tremendous amount of fireworks complaints around the Fourth … and it makes it very difficult for law enforcement to determine what’s lawful and what’s not.”

If a better law can be written, it should include penalties for those found with illegal fireworks. And if a better law can’t be written, then the county should make all such devices illegal in Chautauqua County.
