Gowanda Man Sentenced For Sex Crime Involving Child

Erie County District Attorney John J. Flynn has announced that 40-year-old Kyle Spruce of Gowanda was sentenced by State Supreme Court Justice Paul B. Wojtaszek to a determinate sentence of 18 years in prison followed by 20 years of post-release supervision.

Spruce will be required to register as a sex offender upon his release.

The Gowanda man admitted that he engaged in two or more acts of sexual conduct with a child victim at a location in the southern portion of Erie County between August 2018 and May 2019.

Spruce pleaded guilty to one count of first-degree course of sexual conduct against a child (Class “B” felony) on Aug. 19, 2020.

A no-contact order of protection was issued on behalf of the victim.

DA Flynn commends Investigators Richard Noecker and Amy Kirschman of the New York State Police for their work in the investigation.

The case was prosecuted by Assistant District Attorney Bethany A. Solek of the Special Victims/Domestic Violence Bureau.
