Opt-Out Law Discussed In Cassadaga

CASSADAGA — The issue of whether to allow marijuana dispensaries and smoking dens within the village was tabled at the last meeting of the Village Board.

This week, however, the board introduced two separate opt out laws for both dispensaries and smoking dens. The motions to introduce both local laws passed unanimously through the board.

Both of these issues have been part of the discussion at Village Board meetings, as the deadline for opting out of allowing them comes in December of this year.

Even though the board is presenting both laws to opt out, none of the members of the Board are adamantly against dispensaries.

Instead, the board is mainly moving forward with the opt out laws to schedule a public hearing to hear from the rest of the community.

“Just because you guys offer up a law doesn’t mean you have to go through with it,” said village attorney Joseph Calimeri at their previous meeting. “Even if you adopted the law, you’d have to have a public hearing anyway. You can always come back and not make it a law.”

The date for the public hearing for both issues is set to take place right before the next regularly scheduled meeting of the Village Board, on Aug. 11 at 6:30 p.m.

The issues were voted to be tabled until the Village Board’s second meeting during the month on Aug. 28, with Cassadaga Deputy Mayor Bill Astry adding the board can vote on the issue at the next meeting if they feel they’ve gotten enough input from the community.

“We can take it off the table, if need be,” Astry said.
