Parents File Suit After Child Injured At Panama School

PANAMA — The parents of a child attending Panama Central School have filed a lawsuit against the district alleging negligence after the child was injured in early September.

The lawsuit was filed last week in New York State Supreme Court in Chautauqua County. In it, the parents said their child was injured Sept. 5 while on school grounds.

The complaint, which seeks an unspecified amount in damages, was filed on behalf of the parents by Buffalo attorney Robert Crawford.

Bert Lictus, Panama Central School superintendent, said he could not comment on the suit.

Details of the Sept. 5 incident were not revealed. However, the lawsuit states that the child suffered “serious injuries” and required medical treatment.

The suit, in part, states: “The negligence of Panama Central School District, its officers, agents and employees, consisted of, among other things, the following: negligently failing to supervise the infant claimant and permitting him to go on playground equipment; failing to supervise other students and/or faculty; failing to adhere to internal school policies and procedures that were established by the school district regarding the infant claimant and other students in similar situations; and failing to exercise such care as a parent of ordinary prudence would observe in comparable circumstances.”

The suit further claims the student suffered “permanent injuries from the incident,” including a broken leg. “The total sum to be claimed for such injuries and damages has not yet been determined as of date.”

Crawford did not return a call for further comment.
