Hinsdale Man Gets State Prison Sentence For Narcotics Sales

LITTLE VALLEY–A Hinsdale man convicted of selling narcotics in Olean is heading to state prison.

Michael Scholl, 39, was handed a determinate sentence of two years in the New York State Department of Corrections plus two years of post-release supervision for a conviction of third-degree criminal sale of a controlled substance, a class B felony.

He was sentenced to a concurrent 90 days for his conviction of seventh-degree criminal possession of a controlled substance, a class A misdemeanor.

The charges stem from incidents that occurred between April 11 and May 25 in Olean, in which Scholl unlawfully possessed and sold a narcotic substance.

Other individuals recently sentenced in Cattaraugus County Court included:

Robert J. Ford, 41, of Portville, who was sentenced to five years of probation for his conviction of fourth-degree criminal possession of stolen property, a class E felony. The charge stems from a March 24 incident in Portville, in which Ford possessed stolen property with the intent of benefiting himself or a person other than the owner. The value of the property exceeded $1,000.

Fallon M. Smith, 30, of Delevan, who was handed a determinate sentence of 2.5 years in state prison plus two years of post-release supervision for her conviction of fifth-degree criminal possession of a controlled substance, a class D felony. The charge stems from a June 9 incident in Olean, in which Smith unlawfully possessed a narcotic drug.

Robert A. Richardson, 28, of Randolph, who was sentenced to five years probation for his conviction of third-degree attempted unlawful manufacture of meth, a class E felony. The charge stems from a Jan. 22, 2016, incident in Randolph, in which Richardson manufactured methamphetamine.

Lori A. Cole, 55, of Olean, who was sentenced to two concurrent three-year terms of probation for her convictions of driving while intoxicated, a misdemeanor; and second-degree aggravated unlicensed operation, a misdemeanor. The charges stem from an April 9 incident in Olean, in which Cole drove a vehicle while intoxicated and when her driving privileges were suspended due to an earlier alcohol-related offense.

Charles P. Redeye, 55, of Salamanca, who was sentenced to five years probation for his conviction of third-degree attempted robbery, a class E felony; and petit larceny, a class A misdemeanor. The charges stem from a May 4, 2015, incident in Salamanca, in which Redeye forcibly stole a vehicle.

Individuals who recently pleaded guilty included:

Frederick W. Russell II, 39, of Olean, who pleaded guilty to second-degree attempted assault, a class E felony. The charge stems from an incident that occurred between Aug. 17 and Aug. 29 in Olean, in which Russell intended to cause physical injury to a person less than 7 years old. Sentencing is scheduled for April 10.

Rachel C. Duhan, 25, of Olean, who pleaded guilty to second-degree attempted assault, a class E felony. The charge stems from a July 26 incident in Hinsdale, in which Duhan attempted to cause physical injury to another person. Sentencing is scheduled for April 10.

Bethany Johnson, 42, of Salamanca, who pleaded guilty to aggravated DWI, a class E felony. The charge stems from a July 28 incident in Salamanca, in which Johnson drove a vehicle while intoxicated and while a child less than 15 years old was a passenger. Sentencing is scheduled for April 10.

Richard Kraft, 21, of Olean, who pleaded guilty to third-degree attempted burglary, a class E felony. The charge stems from an Oct. 26 incident in Allegany, in which Kraft unlawfully entered a building to commit a crime. Sentencing is scheduled for April 10.

Anthony S. Laskey Jr., 60, of Olean, who pleaded guilty to third-degree attempted burglary. The charge stems from an Oct. 26 incident in Allegany, in which Laskey attempted to enter a building unlawfully to commit a crime. Sentencing is scheduled for April 10.

An individual who pleaded not guilty included:

Hugh Smith, 44, of Springville, who pleaded not guilty to two counts of DWI, class D felonies; use of motor vehicle without interlock, a class A misdemeanor, seventh-degree criminal possession of a controlled substance, a class A misdemeanor, first-degree aggravated unlicensed operation, a class E felony; fourth-degree criminal possession of a weapon, a class A misdemeanor, reckless driving, a misdemeanor and four vehicle and traffic law violations.

The charges stem from a Dec. 17 incident in Machias, when Smith allegedly fled the police. The matter has been adjourned for motions.
