Man Indicted On Menacing A Police Officer Charge

A 36-year-old man who Dunkirk police say threw his bicycle at their patrol vehicle then advanced at them with a knife has been indicted by a Chautauqua County grand jury.

Juan Resto pleaded not guilty during arraignment Oct. 19 in county court. He was indicted Oct. 15 on a charge of menacing a police/peace officer.

In September, the Dunkirk Police Department said Resto threw his bike at an officer’s patrol vehicle on East Second Street and Washington Avenue when advised he was under arrest. The man had been wanted on two outstanding warrants.

During a foot pursuit, Dunkirk police said Resto produced a large knife and held it up in a menacing manner toward officers. After advancing, the officers deployed a Taser before taking him into custody.

Resto was booked into jail on the warrants for fourth-degree criminal mischief and second-degree harassment.

A conference has been scheduled for Nov. 11 on the indictment charge.
