A conditional certificate of occupancy has been issued for the Jamestown Brewing Company, 115-121 W. Third St., Jamestown.

The conditional certificate was issued Thursday to GPATTI Enterprises LLC and allows the developer and its tenant, Jamestown Brewing Company, access to the building to prepare for the opening of the brewery, restaurant and banquet facility.

“You are allowed to occupy the building to commence brewing operations,” states the letter from Lawrence Scalise, city building and zoning code enforcement officer. “You are also allowed to have employees occupy the building for cleaning, traning and preparing the business to open.”

The city’s only conditions on the occupancy certificate are that kitchen equipment connected to the hood fire suppression system by installed and the system inspected and certified by an authorized company; waitress stations need to be installed and inspected by the building, plumbing and electrical inspectors; the bar in the dining room must be installed and inspected by the building, plumbing and electrical inspectors; and approval to operate the restaurant must be received from the Chautauqua County Health Department.

“Again, once all the aforementioned items are complete and inspected, your final Certificate of Occupancy will be issued and the business will be permitted to begin public operations.”

Occupancy of the former W.T. Grant Building was one of the issues discussed during oral arguments of Jamestown Brewing Company’s lawsuit against GPatti Enterprises LLC in mid-April, with Judge Timothy Walker of state Supreme Court in Erie County scheduling the next conferences in the case for mid-June to allow enough time to potentially have Jamestown Brewing Company inside the building. During oral arguments, Matthew Miller, the attorney from Rupp, Baase, Pfalzgraf, Cunningham, LLC representing GPatti Enterprises, told Judge Walker that the developer was close to securing a certificate of occupancy.
