Pleas And Sentences

LITTLE VALLEY - Lori Pettit Reiman, Cattaraugus County district attorney, announced the following activity in Cattaraugus County Court on Tuesday, Nov. 13:

Brett A. Bunker, 36, of Limestone was arraigned and entered a plea of innocent to an indictment charging him with one count of third-degree arson, a class C felony; one count of third-degree criminal mischief, a Class E felony, and one count of fourth-degree criminal mischief, a class A misdemeanor. On or about Aug. 1, 2012, in Carrollton, Bunker allegedly damaged a motor vehicle by starting a fire or causing an explosion. The case has been adjourned for motions.

Angel L. Ocasio, 31, of Dunkirk was arraigned and entered a plea of innocent to an indictment charging him with one count of second-degree burglary, a class C felony. On Jan. 5, 2012, in the Dayton, Ocasio acted with others entered or remained unlawfully in a dwelling, with the intent to commit a crime. The case has been adjourned for motions.

James "Manny" McClary, 39, presently incarcerated in the Cattaraugus County Jail, was arraigned and entered a plea of innocent to an indictment charging him with two counts of third-degree criminal sale of a controlled substance, class B felonies, and two counts of third-degree criminal possession of a controlled substance, class B felonies. On June 28, 2012, in Olean, McClary allegedly possessed and sold a narcotic drug. The matter has been adjourned for motions

Charlotte K. Colf, 29, of Olean waived prosecution by indictment and entered a plea of guilty by Superior Court Information to driving while intoxicated, a class E felony. On May 5, 2012, in the city of Olean, she drove with a blood-alcohol content of .22 percent. Sentencing is scheduled for Jan. 28.

Demitrius M. Romer, 26, of Olean was sentenced to a term of one to three years in the state Department of Corrections for his conviction of second-degree attempted assault, a class E felony, and one-year conditional discharge for his conviction of third-degree attempted intimidating a victim or witness, a class A misdemeanor. On Fen. 19, 2012, and March 1, 2012, in Olean, Romer, with intent, caused injury to another person by means of a deadly weapon or dangerous instrument knowing that person possessed information relating to a criminal transaction.

Benjamin G. Meyer, 27 of Cattaraugus was sentenced to two terms of one to three years, to run concurrently, in the state Department of Corrections for his conviction of third-degree burglary, a class D felony, and fourth-degree grand larceny, a class E felony. Between Nov. 28, 2011, and Nov. 29, 2011, in Albion, Meyer knowingly entered and remained unlawfully in a building with the intent to commit a crime and stole property.

Michael S. Lecceardone, 39, of Little Valley, presently incarcerated in the Cattaraugus County Jail, was sentenced to one to three years in the state Department of Corrections for his conviction of driving while intoxicated, a class D felony, and to another term of one to three years violating a previously imposed sentence of probation, the court ordered that his drivers license be revoked; he pay a $1,000.00 fine and mandatory state surcharges. On June 23, 2012, in Little Valley, he operated a motor vehicle with a blood-alcohol content of .16 percent.

Ann George, 42, of Franklinville was sentenced to five years probation and restitution for her conviction of third-degree welfare fraud, a class D felony. Between September 2007 and January 2009 in Cattaraugus County, George stole more than $3,000 by fraudulently obtaining public assistance benefits to which she was not entitled.

Colleen J. Bane, 35, address unknown, was arraigned and entered a plea of innocent to an indictment charging her with one count of third-degree grand larceny, a class D felony. Between Oct. 3, 2011, and Nov. 13, 2011, in Allegany, Bane allegedly stole property which had a value of more than $3,000. The matter has been adjourned for motions.

Lacy Davis, 22, of Olean was sentenced to two separate indictments. On the first indictment, she was sentenced to three years probation for her conviction of fifth-degree criminal possession of a controlled substance, a class D felony, and fourth-degree criminal sale of a controlled substance, a class C felony. The indictments charged that on Nov. 4, 2010, in Olean, while acting with another, she knowingly and unlawfully sold a narcotic preparation and possessed a controlled substance with the intent to sell it. On the second indictment, she was sentenced to five years probation for her conviction to fifth-degree criminal possession of a controlled substance, a class D felony, and fourth-degree criminal sale of a controlled substance, a class C felony. On October 28, 2010, in Olean, while acting with another, she sold a narcotic preparation and possessed a controlled substance with the intent to sell it. Each sentence will run concurrently.
