LITTLE VALLEY - Lori Pettit Rieman, Cattaraugus County district attorney, reported the following activity in Cattaraugus County Court on Nov. 19.
Spencer D. Golden, 32, of Allegany, but presently incarcerated in the Cattaraugus County Jail, was sentenced to a determinate seven years incarceration with the NYS Department of Corrections for his conviction first-degree sexual abuse, a class D felony.
Additionally, once he is released from prison, he will be subject to seven years post-release supervision. On or about Feb. 26, 2012, in Olean, he subjected a person to sexual contact by forcible compulsion.
Mark P. Burdick, 18, of Bolivar, but presently incarcerated in the Cattaraugus County Jail, was sentenced to one-year incarceration in the Cattaraugus County Jail, restitution and assessed a mandatory state surcharge for his conviction of second-degree grand larceny, a class C felony. On or about June 9, 2012, in Portville, while acting jointly and in concert with another, Burdick stole property and the value of the property exceeded $50,000.
Frank J. Reilly Sr., 73, of Olean, was sentenced to five years probation to include 100 hours of community service, license revocation, fines totaling $1,000 and assessed a mandatory state surcharge for his conviction of driving while intoxicated, a class E felony. The incident occurred on or about March 30, 2012, in Franklinville, when the defendant operated a motor vehicle in an intoxicated condition, having a .11 percent blood alcohol content.
Jesse C. Bartlett Sr., 45, of Olean, but presently incarcerated in the Cattaraugus County Jail, was arraigned and entered a plea of not guilty in connection with an indictment handed up by a Cattaraugus County grand jury which charged him with third-degree criminal possession of a controlled substance, a class B felony; third-degree criminal sale of a controlled substance, a class B felony; fifth-degree criminal possession of a controlled substance, a class D felony; and fourth-degree criminal possession of a controlled substance, a class C felony. The indictment charged that on several different occasions, in Olean, while acting jointly and in concert with another, possessed and sold methadone and oxycodone. This matter has been adjourned 45 days for motions.
Charles Covert, 47, address unknown, but presently incarcerated in the Cattaraugus County Jail, was arraigned and entered a plea of not guilty in connection with an indictment handed up by a Cattaraugus County grand jury which charged him with three counts of second-degree burglary, class C felonies, and fourth-degree criminal mischief, a class A misdemeanor. The indictment charged that on or about and between March 20, 2010, and Aug. 25, 2010, in Olean, he knowingly entered or remained unlawfully in dwellings with the intent to commit a crime therein and caused damage. This matter has been adjourned 45 days for motions.
Beau E. John, 24, of Gowanda,, was arraigned and entered a plea of guilty to driving while intoxicated, a misdemeanor, and second-degree aggravated unlicensed operation of a motor vehicle, a misdemeanor, to satisfy a pending indictment. On or about Dec. 24, 2011, in New Albion, he operated a motor vehicle in an intoxicated condition and without a valid driver's license. He will be sentenced on Feb. 4, 2013.
Kevin L. Kennedy, 24, of Olean, was sentenced to five years probation, $500 fine and assessed a mandatory state surcharge for his conviction of fifth-degree attempted criminal possession of a controlled substance, a class E felony. On or about Jan. 7, 2011, in Olean, the defendant, knowing and unlawfully attempted to possess a narcotic preparation, to wit, hydrocodone.
Fredrick C Mix, 40, of Killbuck, was sentenced to 30 days incarceration in the Cattaraugus County Jail, five years probation and restitution for his conviction of unlawful disseminating indecent material to minors, a class D felony. Between November 2011 and January 2012, in Great Valley, he unlawfully disseminated indecent sexual material to a minor.
Donald J. Johnson, 24, of Franklinville, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to third-degree unlawful manufacture of methamphetamine, a class D felony. On or about July 11, 2012, in Ischua, he knowingly and unlawfully possessed laboratory equipment and manufactured, prepared or produced methamphetamine. He will be sentenced on Feb. 11, 2013.
William D. Perkins, Jr., 22, of Olean, but presently incarcerated in the Cattaraugus County Jail, was arraigned and entered a plea of not guilty in connection to an indictment handed up by a Cattaraugus County grand jury which charged him with two counts of third-degree criminal possession of a controlled substance, a class B felony, and two counts of third-degree criminal sale of a controlled substance, a class B felony. The indictment charged that on Sept. 11, 2012 and Sept. 14, 2012, in Olean, the defendant possessed and sold a narcotic drug, to wit, oxymorphone and hydromorphone. Additionally, he was arraigned on a violation of probation and entered a denial to those allegations. Both matters have been adjourned 45 days for motions.
Deborah A. Staley, 53, of Kenmore,was sentenced to six months incarceration in the Cattaraugus County Jail for her conviction of petit larceny, a class A misdemeanor. The incident occurred on or about Sept. 2, 2009, in Olean, when the defendant stole property.
