Pleas And Sentences

LITTLE VALLEY - Lori Pettit Rieman, Cattaraugus County district attorney, reported the following activity in Cattaraugus County Court on Monday, July 16:

Gregory E. Farr, 22, of Allegany, presently incarcerated in the Cattaraugus County Jail, was sentenced to a minimum of 19 years and a maximum of life in prison, restitution and a mandatory state surcharge for his conviction of second-degree murder.

Jolene M. Powless, 35, of Allegany, presently incarcerated in the Cattaraugus County Jail, was sentenced to a minimum of two years and a maximum of four years for her convictions of fourth-degree grand larceny and third-degree forgery.

Kimberly A. Bigelow, 44, of Salamanca, presently incarcerated in the Cattaraugus County Jail, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to one count of fourth-degree grand larceny. She also admitted to violating the terms and conditions of a previously imposed sentence of probation. She will be sentenced on both cases on Oct. 1.

David F. Cooper, 47, of Cattaraugus, presently incarcerated in the Cattaraugus County Jail, waived prosecution by indictment and entered a plea of guilty to Superior Court Information to DWI and second-degree aggravated unlicensed operation of a motor vehicle. He also admitted to violating the terms and conditions of a previously imposed sentence of probation. He will be sentenced on both cases on Oct. 1.

Gabriel R. Vann, 36, of Buffalo, was sentenced to one year incarceration and assessed a mandatory state surcharge for his conviction of third-degree attempted criminal sale of a controlled substance. Additionally, he will be subject to one year of post-release supervision.

James M. Hovey, 24, of Olean, was sentenced to two terms of incarceration, consisting of one year each to be served consecutively and assessed a mandatory state surcharge for his convictions of two counts of third-degree assault.

James M. Schichtel, 53, of West Valley, was sentenced to five years probation to include 50 hours of community service, his driver's license was revoked, he was fined $1,000 and assessed a mandatory state surcharge for his conviction of DWI.

David A. Romero III, 30, of Salamanca, was sentenced to five years probation, his license was revoked, he was fined $2,000 and assessed a mandatory state surcharge for his conviction of first-degree aggravated unlicensed operation of a motor vehicle and DWI.

Donald Williams, 23, was sentenced to three years probation and restitution for his conviction of seventh-degree criminal possession of a controlled substance.

Mary L. Heary, 36, of Gowanda, entered a plea of guilty to one count of second-degree attempted forgery to satisfy a pending indictment. She will be sentenced on Dec. 29.

Allen Larkin Jr., 24, of Salamanca, but presently incarcerated in the Cattaraugus County Jail, entered a plea of guilty to one count of second-degree assault to satisfy a pending indictment. He will be sentenced Oct. 1.

Tashana R. Gayton, 31, of Olean, was arraigned and entered a plea of innocent in connection with an indictment handed up by a Cattaraugus County Grand Jury charging her with third-degree insurance fraud, third-degree attempted grand larceny and making a false written statement. The case has been adjourned 45 days for motions.

Kyle S. King, 21, of Gowanda, was arraigned and entered a plea of innocent in connection with an indictment handed up by a Cattaraugus County Grand Jury charging him with third-degree burglary, second-degree criminal mischief, fourth-degree grand larceny and petit larceny. The case has been adjourned 45 days for motions.

Lawrence W. Mohr, 25, of Cattaraugus, was arraigned and entered a plea of innocent in connection with an indictment handed up by a Cattaraugus County Grand Jury which charged him with two counts of third-degree rape, two counts of third-degree criminal sexual acts and three counts of endangering the welfare of a child. The case has been adjourned 45 days for motions.
