KENNEDY - A Cherry Creek woman allegedly smoked marijuana and took several prescription medications before she was involved in a two-vehicle accident on Route 394 in Kennedy on Tuesday afternoon.
Darcy Marquart, 47, of Maple Avenue, Cherry Creek, was charged with failure to keep right, driving while intoxicated and driving while ability impaired by drugs after an accident at 3:52 p.m. Tuesday sent Karl Ackley, 42, of Bentley Hill Road, Gerry, and Linda Ackley, 62, of Mutton Hill Road, Gerry, to WCA Hospital.
According to Chautauqua County sheriff's deputies, a Toyota Corolla driven by Ms. Marquart was traveling west when it entered the oncoming lane and struck a red Toyota Tacoma pick-up truck head-on. The front end of the Tacoma sustained some damage but the front, driver's side of the Corolla was destroyed.
As volunteer firefighters from Kennedy and Falconer picked up the debris, including one of the Corolla's tires, deputies spoke with a witness who said the woman who was driving the car allegedly left the appropriate lane. Ackley was treated and released from WCA Hospital with neck and leg injuries while Mrs. Ackley, his mother, suffered a broken arm in the accident and is listed in stable condition.
Ms. Marquart was uninjured, as was her dog, who was in the car at the time of the crash. She will be in Poland Town Court later. Sheriff's deputies, Kennedy and Falconer volunteer firefighters responded to the accident.
