This was just an accident. Luckily no one got hurt. I think he has been punished enough. What purpose would jail time serve?

So can it now be rightfully argued by the defense that the prosecutor's last minute, so called "misstatement" actually constituted the state's abandonment of all charges that might result in jail time? If so, does that also mean that those charges cannot now be reinstated in the new trial under double jeopardy? Also, in the article appearing on page B1 in yesterday's Buffalo paper, the defense contends that the prosecution never presented "conclusive proof" (forensic evidence?) that bullet actually came from the defendant's gun. The whole thing looks like regular comedy of errors with nobody paying any attention as to what was going on.
