NAFTA Violates America’s Sovereignty

The renegotiation of the North American Free Trade Agreement (NAFTA) provides a historic opportunity to remedy a serious affront to the U.S. Constitution that should concern people from across the political spectrum.

Embedded in NAFTA is a shocking attack on U.S. sovereignty: the Investor-State Dispute Settlement (ISDS). ISDS grants foreign investors rights to skirt domestic courts and instead initiate proceedings against the U.S. government before tribunals of three private lawyers. In these proceedings, foreign investors can demand unlimited amounts of taxpayer compensation for U.S. laws, court rulings and other government actions that the investors claim violate loosely-defined foreign investor rights provided in NAFTA.
