Area Police Reports


¯ PORTLAND — Joseph M. Pencek, 51, of Westfield was charged with DWI-Leandra’s Law (child under 16 years old), driving while ability impaired by drugs and failure to dim high beams. Deputies on Nov. 7 at 8:30 p.m. observed a vehicle failing to dim high beams to oncoming traffic on Route 5 in Portland. Pencek was identified as the driver, and following an investigation he was taken into custody. Pencek will answer the charges in Portland Town Court at a later date.

¯ SILVER CREEK — Gayle E. Nephew, 48, of Perrysburg, was charged with driving while intoxicated, aggravated DWI and failure to keep right. Deputies at 1:27 a.m. on Sunday observed a vehicle driving in the middle of Hanover Street in Silver Creek. The driver was identified as Nephew, and an investigation found that he was operating the vehicle while intoxicated. Nephew will answer the charges in Silver Creek Village Court at a later date.

¯ HARMONY — Cynthia K. Haight, 47, of Jamestown was charged with DWI, DWI per se, moving from lane unsafely and speed not reasonable. Deputies at 2:11 a.m. on Nov. 8 responded to a one-car crash on Route 474 in Harmony. Haight was found to be the driver, and was charged following an investigation. She will answer the charges in Harmony Town Court later.

¯ STOCKTON — Brian L. Tucker, 54, of Buffalo was charged with aggravated DWI, DWI, moving from lane unsafely and leaving the scene of a property damage accident. Deputies responded at 10:38 p.m. on Oct. 27 to a vehicle fire on Route 380 at Waterman Road in Stockton. Following an investigation Tucker was found a short distance from the incident and later charged. He is scheduled to answer the charges at a later date.

¯ SHERIDAN — Matthew R. Eaker, 28, of Fredonia was charged with DWI, DWI per se and speed in zone. Deputies on Saturday at 3:03 a.m. observed a vehicle driving at a high rate of speed on Route 20 in Sheridan. Eaker was identified as the driver, and an investigation determined that he was operating while in an intoxicated state. He will answer the charges in Sheridan Town Court at a later date.

¯ GERRY — Barry S. Mosher, 54, of Gerry was charged with fourth-degree criminal mischief. Deputies responded to a suspicious situation on Kimball Drive at 1:25 a.m. on Friday. Upon arrival, deputies found that Mosher had allegedly damaged property inside the residence. He was taken to Chautauqua County Jail on pre-arraignment bail and is scheduled to appear in Gerry Town Court to answer the charge at a later date.



¯ Shawn M. Battle, 27, of Ashville was charged with petit larceny. Battle turned himself in on a warrant for the petit larceny that occurred Oct. 26 after allegedly taking $124.41 in merchandise from Walmart in Lakewood. Battle was issued an appearance ticket to be in Busti Town Court at a later date.
