Area Police Reports


¯ HANOVER — Julie C. Ervolina, 43, of Hamburg was charged with failure to keep right, third-degree aggravated unlicensed operation and unlicensed operator. Sheriff’s deputies responded around 6 a.m. on Sept. 7 to Route 39 in the town of Hanover for a personal injury accident. Ervolina reportedly fell asleep while driving and crashed into a utility pole. She was transported to Brooks Memorial Hospital for non-life-threatening injuries. She will appear in Hanover Town Court at a later date to answer the charges. The investigation is ongoing, and further charges are pending.

¯ HANOVER — Thomas A. Sporysz, 23, of Forestville was charged with moving from lane unsafely, driving while intoxicated and aggravated DWI with a BAC .18 percent or higher. Deputies stopped Sporysz at 2:30 a.m. on Sept. 6 in the town of Hanover and was determined to allegedly be intoxicated. He will appear in Hanover Town Court at a later date to answer the charges.

¯ SILVER CREEK — Matthew D. Hughes, 36, of Silver Creek was charged with inadequate head lights, inadequate tail lights, operating without insurance, operation with a suspended registration, third-degree aggravated unlicensed operation and uninspected motor vehicle. Deputies stopped a vehicle at 4:30 a.m. on Sept. 6 for a traffic violation. Hughes was found to be driving on a suspended license. He will answer the charges in Silver Creek Village Court at a later date.

¯ PORTLAND — Donald Woods Jr., 53, was charged with third-degree assault and endangering the welfare of a child. The Sheriff’s Office was made aware of an alleged assault that occurred at 5 p.m. on Sept. 5 on Route 20 in the town of Portland. Deputies learned Woods punched a male victim, causing injury. Woods will appear in Portland Town Court at a later date to answer the charges.

¯ SILVER CREEK — Feliz M. Diaz, 43, of Potomac Avenue, Buffalo, was cited for speeding and charged with consumption of alcohol in a motor vehicle and driving while intoxicated after being pulled over at 1:42 a.m. Sunday on Main Street, Silver Creek. Deputies report seeing the vehicle traveling at a high rate of speed. Diaz will be in Silver Creek Village Court later.

¯ POMFRET — Drew T. Palmerton, 19, of Eden was charged with failure to use designated lane, possession of a fictitious license, misdemeanor DWI and DWI per se at 3:42 a.m. Saturday on Route 60 in Pomfret. Palmerton will be in Pomfret Town Court later.

¯ DUNKIRK — A Dunkirk man faces several charges after deputies responded to a report of a vehicle in a ditch at 9:20 p.m. Saturday near Willow and Temple roads in the town of Dunkirk. Deputies found a vehicle in the ditch, but the operator had reportedly left the scene. Eric Lewis, 43, of Brigham Road, Dunkirk, was allegedly found a short distance away from the scene and, after a brief investigation, was reportedly found to be the driver. He was charged with DWI, moving from lane unsafely, leaving the scene of a property damage accident, failure to keep right and aggravated DWI for allegedly having a blood-alcohol content of .18 percent or higher. He will be in Dunkirk Town Court later.


¯ A 17-year-old Jamestown male was charged Aug. 6 with petit larceny, third-degree criminal trespassing and obstructing governmental administration following a report of individuals entering vehicles. At 10:45 p.m., Jamestown police were dispatched to the area of 332 Steele Street where one of the suspects was last seen. Police located a male hiding on a rear exterior staircase of a building. The individual, identified as a 17-year-old male, was placed into custody after struggling with officers and refusing to comply with officer’s commands. It was determined that the male had broken into parked vehicles, searched through contents of a car and stole electronics from inside. The male was also found to have active warrants for his arrest on a separate case. He was transported to the City Jail for arraignment.

¯ Chad M. Nelson, 38, of Jamestown, was charged on Friday after police observed him in the area of 101 Fairmount Ave. Around 10:58 a.m., police said they observed Nelson whom they knew had outstanding bench warrants. He was taken into custody and found to be in possession of methamphetamine. He was additionally charged with seventh-degree criminal possession of a controlled substance.

¯ Crystal D. Butts, 68, of Jamestown was charged with driving while ability impaired by drugs after a traffic stop at 9:50 p.m. Friday near Winsor and Scott streets. A passenger in the vehicle, James M. Werner, 46, of Jamestown, was charged with false personation after allegedly giving police a false name and with third-degree criminal possession of a controlled substance. Both were taken to the Jamestown City Jail until they could be arraigned.


¯ Sandra J. Silsby, 58, of Jamestown was charged with petit larceny following an incident at 4:38 a.m. on Sept. 5. Police said Silsby allegedly stole $29.49 in food from Wal-Mart. She was issued an appearance ticket to answer the charges at a later date.


¯ Jessica Lynch, 26, of Kennedy, was charged Saturday with seventh-degree criminal possession of a controlled substance and unlawful possession of marijuana after she was pulled over on Interstate 86 in Jamestown for a traffic violation. Troopers report smelling marijuana coming from inside the vehicle. After searching Lynch and her vehicle, troopers allegedly found a marijuana cigarette, two bags and a container all containing various amounts of marijuana and 25 grams of concentrated cannabis. Lynch processed at the State Police barracks in Jamestown and released with appearance tickets to be in Ellicott Town Court later.

¯ Alexis Guzman, 21, of Jamestown was charged Saturday with unlawful possession of marijuana after being pulled over on Fairmount Avenue, Lakewood, for an alleged traffic violation. While speaking to Guzman, troopers allege smelling marijuana coming from inside the vehicle. A search of the vehicle reportedly revealed a bag containing a small amount of marijuana and two marijuana smoking devices. Guzman will be in Lakewood Village Court later.

¯ BEMUS POINT — Wade Oram, 46, was charged with second-degree aggravated harassment on Sept. 6 after allegedly making several unwanted calls and sending several unwanted text messages to an unnamed person. Oram will be in Ellery Town Court later.

¯ ELLINGTON — Derrek Bates, 25, of Cattaraugus was charged with DWI on Sept. 7 after allegedly hitting a parked car on Route 83 in Ellington. Troopers report Bates went off the road and hit an unoccupied parked vehicle. Bates allegedly failed several field sobriety tests and was taken to the State Police at Jamestown barracks, where he reportedly provided a sample containing a .17 percent blood-alcohol content. Bates will be in Ellington Town Court later.
