Third City Constable Appointed

The Jamestown City Council filled the third constable position during their voting session meeting held at Chadakoin Park.

On Monday, Sam Teresi, Jamestown mayor, recommended G. Michael Berg of Elam Street to be the newest city constable, with the council approving the nominee.

Since June, a city attorney, constable and landlord have asked city officials to fill the third constable position to help with evictions. The city charter calls for their to be three constables in the city. Marie Hill and Camille M. Krawczyk are the other two city constables.

Harold Whitford, Real Estate Investors Association of Jamestown president, had been to the previous three meetings of the council to ask them to appoint a third constable. Whitford first appeared before the council asking them to appoint Dan Hill, son of Marie Hill, to the constable position.

Following the June meeting, Teresi said city officials were vetting Hill’s application as a potential constable. The mayor also said Hill had applied for the position before, but was not accepted because, at the time, he didn’t live in the city, which is one of the mandates to be a city constable.

In July, Teresi announced two more people also applied to be a city constable.

In August, Teresi discussed the candidates for the constable position with the council during an executive session.

During the process of appointing a third constable, the council hosted Lt. Tim Kindberg of the Chautauqua County Sheriff’s Office to talk about the Civil Division, which handles court order evictions. Kindberg said the office enforces the decision of the courts, which includes evictions. He said they perform evictions in the city, with fewer than one a month usually occurring.

Kindberg discussed the long eviction process from notice of payment to notice of eviction to finally a court ordered warrant of eviction. He said typically the process takes between 4 to 6 weeks. He added the Civil Division also handles other tasks like garnished wages, civil warrants and seizure of property.
