City Approves Three Tort Claims In 2016

Of the 28 claims filed with the city and Jamestown Board of Public Utilities in 2016, only three have been approved so far. One city claim was for $692.18 following a damaged vehicle incident on Main Street between Second and Third streets on June 24.

Two Jamestown BPU tort claims were approved, with both incidents also occurring in June. One incident happened on Newland Avenue on June 29, which was approved for $300. The second BPU claim approved happened on June 14 on West Main Street, which was approved for $93.36. No description of the incident was provided with the BPU tort claims.

Marilyn Fiore-Lehman, city corporation counsel, said the city claims are approved or denied by Jamestown City Council. She said when they receive a claim, it is first brought before the Finance Committee, who decided whether it will go to the full council for a vote. She said the BPU tort claims are handled by the city-owned utilities company officials.

There is one city claim that has not be determined yet. The claim was filed for an incident on April 26 for a false arrest.

In 2016, 14 city claims were denied. These incidents involved snow removal, pot holes, falling tree, raised manhole cover, damaged windshield, damaged mail box and sidewalks. Three BPU claims were denied while eight are still pending.
